In recent years,juvenile delinquency has occurred frequently,and the age of juvenile delinquency has become obvious.The brutal means of delinquency have aroused widespread concern in the society.Investigate its reason,has the minor socialization degree insufficient individual factor;There are also family reasons for poor education and guardianship;More induce juvenile delinquency of the bad social atmosphere.China’s current laws and regulations,such as the Criminal Law,Law on the Prevention of Juvenile Crimes,Law on the Administration of Public Security and Punishment,Law on the Protection of Juveniles,distinguish between the identification and disposal of juvenile criminal acts and adult criminal acts.However,the author believes that China’s current legislation on the juvenile delinquency of the classification of punishment system and the implementation of shortcomings and deficiencies,the juvenile delinquency can not be completely effective regulation.For example,the lack of coordination between institutions,the imperfect implementation rules,the lack of correction,help and education work,and the lag of intervention measures lead to poor correction effect of juvenile delinquent behavior,or even the phenomenon of "letting it go".It can be seen that it has become an urgent problem for the legal circle to perfect the grading punishment system of juvenile delinquents in China.Minor offence behavior classification is compatible to the place of the particularity of juvenile justice,is the inevitable choice of minors vicious crime,and hierarchical place in juvenile conform to the trend of the development of the juvenile justice,especially outside the United States,Germany,France and Japan’s experience is a minor offence behavior classification place provides the feasibility.Therefore,it is necessary to scientifically construct the concept and system of grading and dealing with juvenile delinquent behaviors,establish accurate grading standards for juvenile delinquent behaviors,perfect the precise matching mechanism of dealing with and dealing with delinquent behaviors,and establish the re-socialization integration,help,education and prevention mechanism of recidivism.Exploring diversified treatment methods that are more in line with the physical and mental laws and characteristics of minors,helping delinquent minors to carry out effective education and reform,reversing their wrong ideas and behavior orientation,so that they can return to the society and be a new person.
