A Study On Protection Of Rights And Interests Of People Whose Houses Are Expropriated In China

The development of a city is a process of construction and reconstruction,which involves the demolition and reconstruction of houses.Therefore,house expropriation is an eternal topic.Our country is in the stage of accelerated development of urbanization,and the task of expropriation is heavy everywhere.Because house expropriation is essentially a gain to the social public rights and interests,as an important part of it,the rights and interests of the expropriated should be protected.The current legal system of our country has established the principle of housing expropriation with the rights and interests of the expropriated as the core.However,through the investigation and research,it is found that in the actual collection work,many of the rights and interests of the expropriated are infringed.Due to the vague definition of the subject and purpose of the expropriation in the legal norms,the lack of a reasonable mechanism for the exercise of the rights and interests of the expropriated and the inability to effectively resolve the expropriation disputes,the rights of the expropriated,such as personal rights,property rights,participation rights and the right to know,have been violated.As an integral part of life,when the house is infringed,the impact is more serious than the general tort.In addition,due to the wide range of housing expropriation,it is easy to have mass incidents when the dispute is not handled,which has a bad impact on the society.In order to protect the legitimate rights and interests of the expropriated,we should define the scope of public interest,establish an open and transparent housing price evaluation mechanism and compensation mechanism,establish and improve the dispute resolution mechanism of housing expropriation,improve the existing judicial relief mechanism,and propose to establish a unified housing expropriation management mechanism.In order to add bricks and tiles for the construction of the legal system of urban housing expropriation,protect the legitimate rights and interests of the expropriated,and promote the harmonious development of society.Figure 5;Table 2;Reference 43...
