Research On Civil Legal Aid System For Migrant Workers

Based on the theoretical perspective of the modernization of the national governance system and the ability of governance,it can be found that the civil right of some vulnerable groups,including migrant workers,cannot be effectively guaranteed,typically reflected in the shortage of the civil legal aid system for migrant workers.In order to promote the implementation of the strategy of ruling the country by law in an all-round way,we must construct a civil legal aid system for migrant workers with Chinese characteristics,not only should the conditions of legal aid be properly relaxed and the scope of aid should be expanded,but also the quality of aid should be improved to ensure the effectiveness of migrant workers' civil litigation rights.In addition to the introduction and conclusion,this thesis is divided into four parts:In the second chapter,the concept and value of migrant workers' civil legal aid system were studied.Firstly,"migrant workers" is not a formal legal concept,so it is necessary to define migrant workers by law;Secondly,civil assistance cases occupy the vast majority,so this thesis mainly studies the civil legal aid system for migrant workers.Thirdly,it is beneficial to safeguard the legitimate rights and interests of the disadvantaged groups,to promote the rule of law in the grass-roots social governance,and to the embodiment of the system of protection and distribution of justice for the weak.In the third chapter,the current situation and main problems of migrant workers' civil legal aid system were studied.Starting from the legislation and practice,the related laws,regulations and policy opinions on legal aid for migrant workers is systematically cared,and finds that the legal aid system of our country has not included migrant workers in the legal object,and the scope of legal aid matters for migrant workers is not clear,and the quality of aid is not guaranteed.From the practice situation can be found that migrant workers legal aid mainly in civil cases,large number of group cases,the amount involved in large amounts,difficult to pay,difficult to defend rights is still a cause for concern.In the fourth chapter,the causes of migrant workers' civil legal aid system were studied.First of all,the legislation on the protection of the rights and interests of migrant workers lags behind.Secondly,the government's responsibility for legal aid for migrant workers is not clear,resulting in the lack of human and financial resources related to them,the quality of the guarantee system is not high;Finally,he way of providing civil legal aid for migrant workers cannot meet the demand.In the fifth chapter,the reform of migrant workers' civil legal aid system were studied.from the establishment of a sound legal aid laws and regulations for migrant workers,based on the allocation of justice to build the scope of legal aid for migrant workers,to clarify the specific responsibilities of the government in the legal aid of migrant workers,and so on,this thesis summarizes the countermeasures to improve the legal aid system for migrant workers.
