Since the founding of the Communist Party of China(CPC),CPC has attached great importance to party building.In recent years,it has been proposed to administer the party comprehensively and rigorously,deploy it together with a comprehensively well-off society,comprehensively deepen reforms,and comprehensively administer the country according to law,forming a “four comprehensive” strategic layout.The key to administering the party comprehensively and rigorously is to administer the party in accordance with regulations,and the root of administering the party according to regulations is to build a complete party rules and regulations system.In the report of the 19 th National Congress of CPC,General Secretary Xi Jinping clearly stated that it is necessary to adhere to the organic unification of governing the country according to law and governing the party according to regulations.The leadership of CPC is the most essential characteristic of socialism with Chinese characteristics.Whether CPC can maintain its advanced nature and purity not only largely determines its own survival and development,but also is closely linked to the great rejuvenation of the Chinese nation.Party rules and regulations serve as the basis and standard for comprehensively and strictly governing the party,and are related to the party's long-term governance and the long-term stability of the country.Based on this background,the research on relevant aspects of party rules and regulations has gradually attracted the attention and extensive discussion of many academics.The concept of party rules and regulations as a basic theory of party rules and regulations research is an important part of building the party rules and regulations system.However,there are still controversies and uncertainties in the current research,which has hindered the party rules and regulations system and the process of promoting the rule of law in China.Based on this situation,this article takes the research on the concept of party rules and regulations as the topic,systematically review and standardize it,strive to resolve disputes and remove obstacles,and to contribute to the integration of governing the party according to regulations and law-governed countries,government and society.This article is based on the definition and function of the concept itself.It review the development of CPC using of the concept of party rules and regulations since the founding of the party,finding that concept proposed later than practiced and proposed earlier than defined.And in different historical periods,the CPC Central Committee has different positioning and use of the concept of party rules and regulations.The reason for this situation is mainly due to the different party conditions,national conditions and world conditions at that time.Before the founding of the People's Republic of China,the party rules and regulations formulated by the Central Committee were mainly party constitutions,organizational regulations,party member cadre regulations,and military regulations.Due to factors such as the living environment facing CPC at the time,most party rules and regulations have distinct revolutionary characteristics and lack of normativeness.After the founding of New China and before the reform and opening up,CPC,which completed the transition from a revolutionary party to a ruling party,made some mistakes in the exploration of the socialist road and led to the construction of the party rules and regulations system hindered.Since the reform and opening up,several generations of the CPC Central Committee have made unremitting efforts to strengthen the construction of the party rules and regulations.By revising the relevant provisions of the party constitution multiple times,continuously formulating the party rules and regulations and improving related documents,the construction of the party rules and regulations system has been standardized and institutionalized.Especially at the Fourth Plenary Session of the Eighteenth Central Committee of the Party,the “complete party rules and regulations system” was taken as the “fifth largest system” tied with “a complete legal system,an efficient implementation system of the rule of law,a strict supervision system of the rule of law,and a strong guarantee of the rule of law”,which is of great significance to the construction of the party rules and regulations system,and even to the construction of a socialist legal system with Chinese characteristics.At present,there are still different voices in the academic circles about the concept of party rules and regulations.However,from the perspective of the internal nature of party rules and regulations,it is political,moral,and legal.The “party” of “party rules and regulations” is its political manifestation;the inside shows that the scope of its tough moral constraints is within CPC;the “regulation” is the most direct expression of its rule of law.From a historical perspective,party rules and regulations can be traced in many important speeches and related documents of CPC in the domestic history.In terms of international history,classic writers of Marxist theory have elaborated on this idea in many historical documents.That is,the concept is well-documented in history.From a practical perspective,other concepts have no more obvious rationality and legitimacy than the concept of party rules and regulations.Creating a new concept deepens the negative impact of China's socialist legal system construction.Therefore,the concept of party rules and regulations can be considered as a scientific,reasonable and legal concept.The research of the concept of party rules and regulations is the theoretical basis for the construction of party rules and regulations.Developing the concept system of party rules and regulations is conducive to scientifically guiding the construction of party rules and regulations.Governing the party according to regulations is an important prerequisite and political guarantee for governing the country according to law.Only by improving the party rules and regulations system and adhering to governing the party according to regulations can we provide a fundamental guarantee for comprehensively advancing the rule of law.
