Government Procurement Legal System Responds To The Development Of Small And Medium-sized Enterprises Under The Background Of Mass Entrepreneurship And Innovation

Under the new normal of the economy,“mass entrepreneurship and innovation” has become an important driver of China's innovation-driven development strategy and a new engine of economic development.As an important carrier of “mass entrepreneurship and innovation”,SMEs deserve more attention and support.As a demand-driven macro-control tool,government procurement is conducive to stimulate the entrepreneurial and innovative vitality of SMEs.However,factors such as the high threshold for SMEs to participate in government procurement,lack of detailed preferential measures,and imperfect public service measures hinder the policy functions of government procurement seriously.Therefore,it is of theoretical and practical significance to study how the government procurement legal system promotes the development of SMEs under the background of “mass entrepreneurship and innovation”.This paper mainly uses literature analysis,normative analysis,and comparative analysis to explain the theoretical support of government procurement to promote the development of SMEs under the background of “mass entrepreneurship and innovation”,analyzes the problems existing in the legal system of government procurement in promoting the development of SMEs,and puts forward the path of improving government procurement legal system in promoting the development of SMEs based on the experience of foreign countries.In addition to the introduction and conclusion,this paper is divided into the following four parts:The first part,on the basis of clarifying the concepts of “mass entrepreneurship and innovation”,government procurement and SMEs,analyzes the development situation and direction of SMEs under the background of “mass entrepreneurship and innovation”,and expounds the theoretical logic of government procurement to promote the development of SMEs from the aspects of economic law theory and principles,policy functions of government procurement,and the mechanism of promoting the development of SMEs.The second part analyzes the obstacles for SMEs to participate in government procurement and the current situation of government procurement policies and laws to promote the development of SMEs in our country.It points out the problems existing in the relevant legislation of government procurement to promote the development of SMEs.One is the lack of attention and understanding of the policy functions to promote the development of SMEs;Second,the restrictions on the entry conditions of SMEs and the ways of identification are inappropriate;Third,the preferential measures to support SMEs are not detailed and perfect enough;Fourth,it does not reflect the effect of government procurement on the independent innovation of SMEs;Fifth,public service measures to promote SMEs to participate in government procurement are not perfect;Sixth,the exception of SMEs in GPA negotiations needs to be properly handled.The third part mainly analyzes the measures taken by the government procurement legal systems of the United States,the European Union,Japan,and South Korea to promote the development of SMEs,and draws useful experiences for our country.The fourth part,combined with the problems existing in promoting the development of SMEs in our country's government procurement legal system and the beneficial experience abroad,puts forward the path to perfect our country's legal system of government procurement to promote the development of SMEs.One is to attach importance to the policy functions of government procurement to promote the development of SMEs;The second is to eliminate unreasonable barriers to entry and clarify the certification mode and definition standard of SMEs;The third is to refine and perfect the preferential measures such as reserved purchase shares;The fourth is to attach importance to the role of government procurement in promoting independent innovation of SMEs;The Fifth,strengthen supporting public services to support the development of SMEs;The sixth is to use GPA rules to promote the development of domestic SMEs.
