Research On The Legal System Of User Information Security In Information Platform Service In China

Since the vigorous development of the data age,the wide popularization and development of Internet and computer technology have provided a more convenient network environment for the information dissemination platform.Paper media,broadcast and other traditional physical media have been difficult to meet people's real-time demands for real-time information in the network attack environment.Based on this background,the information communication platform of our country presents unique function diversification and interaction complexity,and various self-Media platforms emerge as the times require.The excessive development and utilization of information has posed a great risk threat to the internal and external security of user information.The problems of user information security and personal data privacy,which arise from it,are also concerned by the public with a large number of bad events such as leaks and network attacks.At present,more than 90 countries in the world have made special legislation on the protection of personal information security.Compared with the developed countries such as Europe,America and Japan,China's relevant legal system shows obvious lag.Although the provisions of civil law,criminal law,administrative law and separate law involve the relevant content of personal information protection,the legal system still needs to solve the problems of unclear regulation,low level of effectiveness,multi-directional law enforcement,single channel of legal relief and the difficulty of proof.Therefore,it is particularly important to analyze the user information security system of the communication platform service.By analyzing the system content of the current laws and regulations,we can speed up the enactment of the personal information protection law in China,which can not only protect the rights and interests of the user's personality right,privacy right,etc.,but also improve the legal system of our country.This paper is divided into three parts,including the introduction,the main body and the conclusion.The main essay is divided into the following three parts:First part explains the basic framework,including the definition of information platform service,the legal definition of personal information protection and the definition of user information life cycle.In the definition of information platform service,the concept of information platform and the concept of information service are clarified.The second part focuses on the legislative process of the user information security legal system in the information platform service,which is divided into the Internet Security Legislative stage and the big data legislative stage under the new security concept strategy.This paper summarizes the categories of legal documents,promulgating units and time,legal names and information security focus areas involved in each legislative stage.The third part analyzes the content of the user information security legal system in the information platform service in detail,and sorts out the legal content and analyzes the legal system of seven modules,including the legislative principle,the user information disclosure system,the security and confidentiality system,and the security use license system.By comparing the legislative development of the vertical time line and the revision of the reform content,this paper discusses the current situation and the defects of the information security law of the users of the information communication platform in China.
