| Since 2015,the number of rural residents’ hostels has increased dramatically through the "east wind" of rural tourism and shared economy.The government attaches great importance to rural residents’ hostels and continuously issues policies and management measures or guidance opinions related to rural residents’ hostels.For example,on October 15,2019,China’s Ministry of Agriculture and Rural Affairs issued the "Notice of the Ministry of Agriculture and Rural Affairs on Actively and Safely Carrying out the Work of Exploiting and Utilizing Idle Homestead and Idle Homestead in Rural Areas"(Nongjingfa [2019] No.4)to encourage the development of rural residential accommodation.All this shows that the development of township residential buildings is being paid more and more attention.At the same time,the legal issues concerning the supervision of township residential buildings by the government are becoming more and more important.This paper mainly studies the legal issues of the supervision of the township residents’ accommodation government.Through the analysis of nearly 30 administrative measures or guidance opinions collected from documents and official government websites,it is found that the legal issues of the supervision of the township residents’ accommodation government are mainly highlighted in two aspects:the supervision mode and the legislative issues.As for the supervision mode,the limitation of the traditional command supervision mode usually adopted by the government begins to appear,the joint inspection system adopted in the operation process is not flexible enough,and the linkage mechanism to investigate and punish illegal acts has defects.On the other hand,there are mainly six legislative problems in the supervision of the township residents’ lodging government,such as lack of supervision basis,unclear supervision subject,lack of unified legal definition of the township residents’ lodging,unreasonable admission standards for the township residents’ lodging industry,contradictions in the approval process of the township residents’ lodging,and incomplete punishment regulations for operators violating legal responsibilities.In view of the above problems,we can properly learn from the supervision experience of overseas regions and national villages and towns,and further improve the supervision of villages and towns’ villages and towns’ accommodation government according to the actual situation in our country.As for the supervision mode,we should innovate the supervision mode by strengthening economic incentives,strictly implement the principle of "double randomization and one disclosure" and mandatory sharing of information,add administrative punishment measures such as warnings and a certain amount of fines,and strengthen the practical operability.In terms of legislation,we insist on top-level design of the supervision basis for rural residents’ accommodation,urge the local authorities to issue management measures for the supervision of rural residents’ accommodation as soon as possible,clarify the supervision basis and supervision subject,and urge the nationwide unification of the definition of rural residents’ accommodation.It is different from hotel industry in terms of industry access standards.It is encouraged to adopt and stipulate the minimum industry access standards and approval process in the form of laws. |
