A Research Of The Government Responsibility For The Protection Of De Facto Unattended Children

Parents are the natural guardians of children.However,de facto unattended children are faced with a series of derivative dilemmas caused by the absence of parental roles.Nominal parents are infringing their rights to survival and development.On the one hand,the "disappearance" of parents often puts the de facto unattended children into poverty,facing the test of survival and physical health.On the other hand,the absence of family relationships and the lack of spiritual care make most of them unable to talk or even speak silently,and their inferiority and autism tend to be obvious.The lack of moral education,exclusion and discrimination from peers,bears a great spirit in them.At the same time,it is extremely vulnerable to being induced to embark on the road of crimes and endanger the society.Therefore,it is important to protect the healthy growth of de facto unattended children and include them in the state's institutional assistance system.When parental custody responsibilities are absent,it is important for the government to protect the rights and interests from infringement.Since the 19 th CPC National Congress,China's socialist construction has entered a new era.The Fourth Plenary Session of the 19 th Central Committee put forward: "Promoting the well-being of the people and promoting the all-round development of the people are the essential requirements for our party to make the party public and govern for the people.The basic public service system of the state,including childcare,education,employment,medical services,elderly care,housing,and social assistance,focuses on strengthening inclusiveness,basicity.The development of people 's livelihood is essential to ensure the basic lives of the people.”Children are the future of the country and most important part of society.The de facto unattended children is the weakest group among them.It strengthens the government 's sense of responsibility for protecting this group and promotes it.The government has changed from being responsible for fulfilling its responsibilities.In the critical period of poverty alleviation,the government should help the de facto unattended children out of the quagmire of poverty,and establish a sound long-term protection mechanism for guardianship,education,and medical care.The due meaning of government construction in the new era is also a new task of responsibility that the government must face in the new era.There are six parts in this thesis.The first part is the introduction,which mainly elaborates the research background and significance of the government responsibility for the protection of de facto unattended children in China.Then it briefly introduces the research ideas,research methods,innovation points and deficiencies of this article,and paves the way for later research.The second part first defines the related concepts of de facto unattended children and government responsibility in China,and clarifies the relationship between the two things: the government is the most important responsible body for the protection of de facto unattended children and bears the responsibility of the protection of de facto unattended children.The government has the responsibility for policy provision,financial support,supervision and management,and guidance for social participation in the protection of de facto unattended children.Secondly,it expounds the core viewpoints of the theory of government responsibility and the theory of children's rights.The third part is an overview of the growth dilemma faced by de facto unattended children and the current state of government protection of de facto unattended children.The fourth part is the problem and cause analysis.This chapter uses policy supply,financial support,supervision and management,and social participation as the analysis framework to analyze the government responsibility for de facto unattended children.The fifth part is the choice of ways to improve the government's responsibility in the process of protecting de facto unattended children in China.Problem-oriented,from the perspective of improving the relevant legal protection system,enhancing the support of special funds,rationally dividing administrative supervision responsibilities,building an information sharing platform and government-society linkage,etc.,put forward feasible suggestions for the protection of de facto unattended children in China,and promote precision.,Long-term,comprehensive protection.The sixth part is the conclusion.
