Research On Xunwu Court's Circuit Trial

With the market economy and the flow of farmers,the diversification of employment and income differentiation,the traditional closed rural structure has been impacted,the rural society presents the characteristics of "semi mature society",the rural society is difficult to maintain the basic order of life only by internal forces,and the promotion of rural rule of law is irreversible.In this context,Jiangxi Xunwu court has explored a set of effective "Xunwu experience" in practice.The circuit trial of Xunwu court is a characteristic practice of "Xunwu experience",which is dominated by the judges of the grass-roots courts,with the concept of active justice,and with the theme of "joint village governance and FaRun Township style".It has achieved certain results and has certain value.Taking the circuit trial of Xunwu court as the research object,this paper combs its system design,practical practice,effectiveness and value,analyzes its practical details and theoretical logic,so as to provide a model for the circuit trial reform of grass-roots courts in underdeveloped regions in China.In addition to the introduction of the reasons for choosing the topic,the current research situation and research methods,the article is divided into three chapters:The first chapter: the system and practice of circuit trial in Xunwu court.The Xunwu court has formulated relevant implementation rules for the circuit trial,and the system design of the full coverage of the circuit trial also has its own characteristics.The main practices in practice include the combination of autonomy,rule of law and rule of virtue,the principle of Party centeredness,and the combination of "local knowledge".Chapter two: effect and value.The effect of the circuit trial of Xunwu court in resolving contradictions,sending law to the countryside and promoting the rule of law in rural governance is obvious to all.On the micro level,it can solve disputes quickly and efficiently,maintain the harmony and stability of rural society,and achieve the goal of harmonious and good governance of rural society.On the macro level,the circuit trial of Xunwu court can serve as a model for the reform of the circuit trial of grass-roots courts,and provide a reference model for the vast inland underdeveloped areas.The third chapter: thinking about the circuit trial of Xunwu court.This part analyzes what should be paid attention to in the practice of circuit trial of Xunwu court from two angles of judicial tension and procedural justice,and sums up that the implementation of circuit trial must grasp the balance between judicial tension and limit,and deal with the relationship between procedural justice and substantive justice.
