Research On Local Legislation Guarantee Of Social Pension Service In China

The aging of the population is an inevitable outcome of social and economic development and an inevitable trend of global population growth.In order to actively respond to the social problems brought about by the aging of the population,in 2017,the state launched the “13th Five-Year Plan for the Development of Old Ageing and the Construction of the Aged System”,and localities actively explored a variety of old-age models in light of local conditions.However,as the current pension service system is still in its infancy,there are inevitably some problems and deficiencies.The most prominent one is the local legislative guarantee for old-age services.The establishment of a sound old-age service system must be based on legal guarantees and prerequisites.Legal protection is also a requirement to improve the quality of old-age services and to continuously standardize the old-age service system.In 2015,the state introduced the newly revised "Legislative Law of the People's Republic of China",which gives local jurisdictions to the districts.Local governments can make up for the current national laws and regulations in local social affairs by formulating more forward-looking and overall local regulations.As a blind spot in management,and as an important part of social affairs management,old-age services can solve many problems in the process of constructing and improving the old-age service system through local legislation.The author will start research on the local legislative guarantees for domestic social pension services from the following sections.The author will start research on the local legislative guarantees for domestic social pension services from the following sections.Firstly,the concepts related to the local legal protection of social pension service are expounded.The connotation and rights attribute of social pension service are analyzed,and the relevant theories are analyzed and analyzed to provide theoretical support for subsequent research.The second part explores the status quo of local legal protection for social pension services.Firstly,the legislative status of social pension services in various regions at the present stage will be elaborated.The local laws will guarantee the pension in the multi-dimensional from the support of private capital,the basic service guarantee for the elderly,and the responsibility for the aged care services of the family,the government and the market.The support role of services is analyzed.Finally,from the aspects of the government's various legal provisions and the market access mechanism of the aged care service,the current situation of local legislation on the supervision and management of social participation in the aged care service is analyzed.The third part analyzes the problems existing in the local legislation in the field of social pension service.It focuses on the analysis of the incomplete and operability of the legislative system in the field of social pension services,and discusses the reasons.The fourth part is aimed at these problems,and proposes to improve the integrity and operability of the legislation,give full play to the government's supervision,management and support functions in social pension,and promote the continuous improvement of the domestic social pension service legal liability system and balanced development.Four recommendations for the old-age model.
