A Study On The Crime Of Sexual Invasion Of Minors By Teachers

Teachers are the noblest and most respected profession in our country.Because of the nobleness of teachers' profession,teachers are generally given the greatest trust.In each student's era,teachers have a far-reaching impact on students' learning and life.A healthy teacher-student relationship will bring good opportunities and positive effects to students' life development.But at the same time,we note that the unequal status relationship between teachers and students may also be used by some teachers as a criminal tool to infringe on the legitimate rights and interests of minor students,and cause long-term harm to minor students and society.This situation is particularly evident in the cases of teachers using professional privileges to infringe on minor students.Teachers' sexual assault on minors is a universal crime in all countries of the world,and in recent years,the occurrence of teachers' sexual assault on minors has become more and more intense.Minors are the future of the country and society.In order to better protect the legitimate rights and interests of minors,the author believes that it is necessary to study such crimes.The first part of this paper is an analysis of the characteristics of teachers' sexual assault on minors.The author selected 41 judgments from the Judicial Documents Network and made a simple statistical study,which mainly includes three aspects: the spatial distribution characteristics of the case,the characteristics of the offender and the characteristics of the victim.Among them,the characteristics of the spatial distribution of the cases are concentrated in the economically backward provinces,rural areas and schools;the characteristics of criminals are mainly middle-aged and elderly teachers,class teachers and primary school teachers;the characteristics of victims are that many people in one case suffer at the same time,and the same person suffers many times and when he is victimized.It is characterized by long duration and the young age of the victim.These characteristics provide a powerful help to our later prevention work.The second part of this article is an analysis of the process of teachers' sexual assault on minors.The process of this kind of crime is divided into three parts: the choice of victim target before the crime,the means of inducing in the crime implementation,and the means of maintaining relations after the crime is committed.Firstly,the lack of guardianship and introverted minor students are easy to become the target of the offender's choice of sexual assault;secondly,private tutoring,deception,use,violence and threat are the main inducement means in the implementation of crime;finally,giving the victim benefits to deceive,establish love relationship,threat and intimidation are the main means to maintain the relationship after the implementation of crime.The third part of this article is the analysis of the causes of teachers' sexual assault on minors.The author tries to analyze the causes of such crimes from three perspectives.Firstly,because of the unequal status relationship between teachers and students,the author explains the origin of the unequal status relationship and how teachers make use of their superior position;secondly,according to the theory of criminal opportunity,it is because the professional convenience of the offender's "teacher" status brings more criminal opportunities,which comes from the strong dependence of interpersonal relationship between teachers and students and the lack of corresponding schools.The lack of supervision and victim guardianship is finally due to the cognitive differences between teachers and students,which are specifically strengthened by the low cognitive ability of victims and the misleading of criminals.The fourth part of this article is the crime prevention analysis of teachers' sexual assault on minors.According to the third part,the author puts forward the corresponding preventive countermeasures.Firstly,in order to promote the formation of equal status relationship between teachers,it is necessary to strengthen students' personality awareness education and enhance the awareness of minors' rights and enhance the ability of victims to resist sexual abuse;secondly,it is necessary to reduce criminal opportunities,specifically in order to improve the threshold of teachers' professional entry,strengthen and improve school supervision,and strengthen the supervision of minors;finally,it is necessary to reduce criminal opportunities.In order to improve the cognitive ability of minors and narrow the cognitive gap between teachers and students as far as possible,we should popularize sex education,teach preventive infringement knowledge at different stages in school education,guide reasonable sex knowledge in the family,and improve the identification ability of minors in the face of teachers 'illegal behavior.
