Research On Legislation Of Pet Dog Management In China

With the rapid development of the economy,people's living standards have been increasing,and people's lifestyles have undergone some changes.Pet dogs have become the new fashion trend of today's people.In recent years,the number of pet dogs has grown rapidly.While giving people happiness and relieving pressure,it has also produced a series of social disputes and management problems.For example,frequent incidents of pet dogs in the localities,pet dogs in the community cause disturbances between neighbors,pet dogs do not promptly vaccinate,there are hidden dangers of carrying viral diseases,pet dogs are lost or abandoned as stray dogs,and also hinder social management.At this stage,the management system is immature,the management power is not in place,the laws and regulations are not perfect,and the laws and regulations are not clear about the authority of the functional departments,which leads to the relevant departments arguing with each other.In order to manage pet dogs,the regulations on dog management based on local regulations and local government normative documents have been issued throughout the country,but most of the management regulations are obsolete and do not conform to the development of the times.Some regulations are not specific enough.One size fits all,and some regulations are too harsh,and the design of the management system is unreasonable and imperfect,which also leads to problems in implementation that are difficult to implement and not in place.This paper takes the status quo of pet dog management legislation as the starting point,compares domestic and foreign pet dog management legislation,analyzes the problems and shortcomings of domestic pet dog management legislation,learns the legal system of foreign dog management,and improves the management of pet dogs in China.The legislation provides feasible recommendations and lays the foundation for the introduction of laws and regulations specifically for the management of pet dogs in China.The body of this article is divided into four parts:The first part: Through the analysis of the status quo of existing pet dog management legislation in various parts of the country,we can find out the shortcomings of legislation.This part mainly discusses the current situation of China's pet dog management legislation from relevant laws,local regulations and local government regulations.The problems existing in pet dog management legislation mainly involve four aspects: legal system structure,legislative concept,legal norm content and legal norm operability.The second part: This part compares domestic and foreign pet dog management legislation,not only the comparison of pet dog management legislation between different parts of the country,but also the comparison of domestic and foreign pet dog management legislation.By comparison,you can learn about foreign pets.The advantages of dog management legislation,and can absorb the experience of domestic governance,to make up for the existing pet dog management related systems,laws and regulations.The third part: This part summarizes the shortcomings of China's pet dog management legislation,mainly sums up four shortcomings,namely,the irrational structure of the legal system,the defects of the legislative purpose,the imperfect legal norms,and the operation of the legal norms.Sex is not strong.The fourth part: This part is a proposal to improve the legislation of pet dog management in China,which mainly includes three aspects: legislative guiding ideology,management subject and specific management system.The significance and value of this paper on the comparative study of pet dog management legislation are mainly as follows: First,it is helpful to provide a theoretical basis and directional proposal for the construction of the national pet dog management system,and promote the introduction of a special dog-oriented treatment in China.The second is to help solve the problem of the current implementation difficulties;the third is to help improve the management level of the management department;the fourth is to help maintain public order,urban environment and social harmony.
