Ecosystem Management is regarded as the direction of international environmental law. The dissertation keeps up with this trend, coupling the idea of Ecosystem Management to legislation, questing the approach how to materialize it in the legislation for conserving wetlands in China. Environmental degradation of wetlands is known as one of the most serious problems, but the legislation of wetlands conserving is weak. A new scientific idea, Ecosystem Management, must be introduced into the future proceeding. The dissertation includes three parts: actuality evaluation, theoretic analysis and application framework.The first part is actuality evaluation on the wetlands protection, which covers Chapter One and Two. Chapter One presents wetlands'particular characteristics of multi-level structures, multi-dimensional functions and complex biogeochemical recycles. The Environmental Quality and the Ecological Conditions of wetlands in China deteriorate rapidly with unreasonably utilizing. The direct cause is bad management, deficient legal system, and so on. The crux lies in the fact that it is difficult to handle the relations between the limit and the distribution. Chapter Two Reviews the legislation history of wetlands conservation in China and evaluates the wetlands-related regulations today. The author finds out they all disregard the systematicness and integrity of the wetland ecosystem: On the view of resource utilization, the former regulations pay more attention to the environmental components, which leading to inefficiency cross-admistrative management. In addition, management bases on the administrative area division, which violating the order of the nature, is not up to the requirement of wetlands conservation.The second part, which covers Chapter Three, Four and Five, is the theoretic analysis on Ecosystem Management Law. Ecosystem Management accords great importance to ecosystem. It brings ecosystem into the natural-economical-social system, adopts multi-disciplinary knowledge, integrates all kinds of adjustment mechanism. Wetland is just the complex ecosystem with interactions between ecology, economy and society. So Ecosystem Management is essential to the conservation of wetland ecosystem. The paper tries to conclude the principles of wetland Ecosystem Management legislation. Breaking through the old means of protection, the author discusses several fundamental protecting mechanisms, in order to carry out the Ecosystem Management idea.The third part (Chapter Six) tries to develops a comprehensive legislation framework of wetlands conservation. It must be composed of three comprehensive, harmonious parts: international convention acceded, central legislation and local legislation. Wetlands legislation is of great importance. It bases on the natural boundaries of wetlands. The trans-district management will tune with the natural qualities of wetlands, and demonstrate the superiority of Ecosystem Management. |
