Research On Problems Of Legislation On Our Country's Costal Zones

As a very special region on earth, physical geography of coastal zones is unique, rich in species formation and in an advantageous location. However, with the excessive concentration of human development and utilization activity, the coastal zone is also undertaking increasingly severe environmental stress. How to implement effective coastal zone management, to achieve the overall environmental protection balance of coastal zone development and utilization of implementation, are enormous challenges being faced by countries over the world. From the current practice of related country, setting up coastal zone management mechanism in conformity with the state's actual conditions, carrying out the necessary legislation on coastal zone is essential experience to achieve effective implementation of coastal zone management.Study on coastal zone legislation, we must accurately define the concept of the coastal zone first. This is not just the seriousness of a legal concept, but also because it involves the scope of the coastal zone and the ensuing key issues such as the set of management system. This is necessary in concluding on the basis of scientific knowledge, combining with the domestic and foreign legal definition, grasping it accurately in the context of Law. On this basis, taking full advantage of absorbing and referring to the relevant legislation experience of developed countries, conducting in-depth analysis of the study on China's coastal zone status quo, Studying and putting the question of necessity and feasibility of improving our country's coastal zone legislation.The procedure of legislating for the coast zone could not pass over a key issue which is its management mechanism. Even though countries use various methods to management cost zone, but as a whole, it can be classified into three types which are "centralized management-type","semi-centralized" and "loosely managed". Objectively, the former two types are more scientific in system setting up and effects will be more remarkable, comparing with the third type. At present, our country's coastal zone management mechanism is basically "loosely managed" type. It desperately needs to be turned to the trend of "semi-centralized" and "centralized management-type".Based on the respect of the legislation on costal zone clearing and management system, it is necessary to draw a picture to clarify its purpose, basic principles and main system. The purpose of coastal zone legislation should be based on the fact in our country, and commit to costal zone sustainable development. In another word, develop costal zone utilizing and protection simultaneously. As the principles, it should be particularly emphasized on the integrated management mechanism based on both sustainable development and ecosystem-based management. On the specific design of the mechanism, it should not only be fulfilled the sophisticated system,such as environmental impact assessment system, licensing system and compensation system, but also highly regard developing integrated costal zone plan and playing the role of the main function of geographical zoning system.The main feature of this article is systematic study of Legislation on coastal zone issue. Our coastal zone legislation was failed in the eighties of the last century, due to relevant institutions hold different views on this issue, to a great extent it also caused by people doubt on the necessity of costal zone integrated management and lack of systemic understanding on content, mode and management mechanism of the costal zone legislation. In this context, this article is to promote our coastal zone legislative work, in order to solve the existing difficulties on our costal zone sustainable development by systemic studying on legislation necessity, legislation module, legislation purpose, the basic principle, management system as well as researching on related police.
