A Research On Some Questions Of Basin Management Legislation In Our Country

Basin Management means to manage water resource and regard river basin as a unit. Implementing basin management of water resource is a way which a lot of countries try to find out in a long-term, and the way already become a general trend in the world. In our country, in order to solve water environmental pollution, water resource wasting and water resource shortage, the most important step is to study basin management legislative question and build efficient laws, so we should come to realize the continuous utilization of water resource and promote the social economic sustainable development. Carrying on basin management legislative research, should first define the intension of basin management. Secondly, we should study foreign success experience on basin management legislation, especially U.S.A., Britain, France, Japan, and Australia. We can get enlightenment from them, and prepare precondition to study the basin management legislation of our country. Finally, we should analysis the advantages and disadvantages of our country's regulation system on water resources, and correct the existing problem. After analyzing and researching, I think we should build our country's basin management legislation in following ways: Firstly, we should define concept and corresponding legal norm on " basin manage " in environmental protection law, water law, etc. Secondly, we should make out" basin manage law "and define basin management's status, duty, authority of organization to guarantee on the powerful centralized management and the scattered administrative division management. Thirdly, we should make out the special basin management rule to every great rivers and lakes, especially to the Changjiang River, and the Yellow River. Fourthly, we should perfect the relevant auxiliary law and legal system.
