Research On The Quality And Safety Risk Prevention And Control Legal System Of Imported Agricultural Products

In recent years,with the national quality of life level of ascension,countries pay more and more attention to the quality and safety of agricultural products risk issues: general office of the ministry of agriculture in the agricultural product quality safety priorities for 2018,emphasize around weak links and key areas,in accordance with the regulation,supervision,fight,bat,strict controls of agricultural product quality safety risk,strengthen risk assessment screening;The national plan for sustainable agricultural development(2015-2030)clearly states that it is necessary to strengthen the inspection,quarantine and quality supervision and management of imported agricultural products,improve the risk assessment mechanism for damage to the agricultural industry,and actively participate in the formulation of international and regional agricultural policies and international standards for agriculture.The food safety law of the People’s Republic of China(hereinafter referred to as the food safety law)revised and implemented in 2015 clearly establishes a food safety risk monitoring and risk assessment system and continues to improve in practice.The quality and safety of agricultural products is a major livelihood issue,as well as the source and primary guarantee of food safety.Therefore,it is of great significance to prevent the quality safety risk of agricultural products and ensure the quality safety of agricultural products.However,the quality and safety risk prevention and control system of imported agricultural products is not perfect,and the quality and safety of agricultural products is under post-supervision.Various regulations and standards on the quality and safety risk monitoring of agricultural products are too complicated to be accurately applied.The responsibilities of relevant departments are unclear and the organization is disordered.The quality and safety risk prevention and control inspection and quarantine standards of agricultural products are not in line with international standards and lag behind developed countries.First,in terms of the concept of supervision,emphasis should be placed on the response after the event rather than the prevention in advance;Second,in the aspect of law enforcement subjects,the functions are separated from each other and there is no linkage between departments.Third,in terms of law enforcement means,the traditional methods are backward and the technology update is slow.In order to effectively deal with the quality and safety risks of imported agricultural products,an efficient and reasonable prevention and control legal system for the quality and safety risks of imported agricultural products is constructed.In this paper,based on the risk prevention and control theory,at the same time,draw lessons from the United States,the European Union,Japan and Germany the four countries the advanced experience of food quality and safety risk control,build in risk identification system,risk assessment system,risk prevention system,risk of resolving system imported agricultural product quality safety risk prevention and control mechanism,to perfect our country imported agricultural products quality safety risk prevention and control system to provide system support,ensure national food security.
