The Research On The Predicaments, Causes And Countermeasures Of China's Anti-corruption Pursuit Evasion Abroad

At present,crimes of corruption and bribery are being severely punished in our country.The public security and procuratorial departments have implemented special actions such as "Fox-hunting" and "Skynet" successively,focusing on cracking down on those suspected of corruption and bribery who flee abroad.This is a deterrent to corrupt elements who are still at home or abroad.However,in the specific practice of overseas pursuit,there are still many difficulties to break through: first,the restrictions of domestic laws and regulations,as well as the difficulties in the implementation of human and property aspects of overseas pursuit,as well as the limitations of the characteristics of the case itself.The two is obstacles to international politics,economy and law.Through research,analysis of relevant laws and regulations and other normative documents,combined with personal experience of the pursuit of evasion cases,this paper attempts to explore countermeasures to solve the above difficulties and obstacles and work methods conducive to more effective pursuit of evasion and prevention,in order to carry out in-depth anticorruption work,especially anti-corruption work of grass-roots supervisory organs,for ideas.In addition to the introduction and conclusion,the thesis is divided into four chapters.The first chapter briefly describes the background of our overseas pursuit.Starting from the concept and significance of overseas pursuit and evasion,and from the history and future development of overseas pursuit and the common practices of overseas countries and regions,this paper outlines the improvement direction of overseas pursuit and evasion in China.The second chapter discusses the predicament faced by our country from the two aspects of internal and external aspects.In terms of domestic factors,it mainly faced with the lack of legal basis,insufficient guarantee of relevant systems and insufficient effectiveness of pursuit measures,etc.In terms of external factors,the main problems are lack of trust in the international environment for the rule of law in China,lack of initiative in assisting the pursuit of fugitives and lack of some extraterritorial laws in the hiding place of fugitives.The regulations are not conducive to China's pursuit of overseas pursuit and other difficulties.Chapter ? makes an analysis of the reasons for the dilemma of pursuit and flight in reality,and sums up the reasons of domestic system,international cooperation and grassroots work.From the perspective of domestic legal provisions,there is a lack of necessary legislation,relevant laws have not been amended for a long time,and the utilization rate of existing laws is low;from the perspective of international cooperation,the number of extradition treaties signed with other countries is small,the legal provisions of different countries are different and the implementation of conventions is still inadequate;at the grass-roots level,the anti-flight work is not in place and compulsory measures are taken.Lack of timely use and full play of the cooperative pursuit force are the reasons for the difficulty of pursuit.Chapter ? starts with the three reasons of Chapter III,focusing on the countermeasures to improve our overseas pursuit and evasion work.Firstly,we should implement more standardized exhortation measures on the most commonly used means of exhortation;secondly,we should strengthen international cooperation to promote our country's overseas pursuit;and thirdly,we should make every effort to improve the effect of overseas pursuit and evasion through the effective use of various overseas pursuit and evasion measures.
