Research On The Pension Security Problem Of Landless Farmers From The Perspective Of Social Security Rights

Landless farmers refer to vulnerable groups who have lost their land due to various reasons and have lost the basic rights originally attached to the land.The research object of this article only refers to farmers who have lost their land because of land expropriation.As a basic human right of modern society,the right to social security is a fundamental right to maintain the survival,equality,dignity,basic freedom and development of citizens.The implementation of the right to social security takes the protection of the rule of law as the basic path.In the crucial period of decisive victory in building a well-off society in an all-round way,the implementation of the social security rights of landless farmers has seriously affected the realization of their old-age security.The most fundamental reason is that the legislation is incomplete,that is,there is no corresponding legislation to regulate it.Therefore,from the perspective of social security rights,this article starts with the judicial practice and current status of legislation on the endowment insurance for landless farmers,summarizes the problems existing in the endowment insurance legislation for landless farmers,and proposes corresponding suggestions on the basis of this.This article first puts forward the issues to be studied,the significance and value of the research,the analysis summary of the existing research in China,the research focus and research characteristics.On this basis,the first chapter discusses the basic content of endowment insurance for landless farmers,leading to the research object of this article.The second chapter introduces the judicial practice and status quo of legislation of endowment insurance for landless farmers,and summarizes the problems in the form,content,operation and rights relief of the endowment insurance legislation for landless farmers in China.The third chapter starts from the theoretical background and the legal basis,and demonstrates the necessity and feasibility of endowment insurance for landless farmers.Chapter IV puts forward corresponding legislative countermeasures for theimplementation of endowment insurance for landless farmers from the perspective of social security rights: starting from the principles that must be followed to protect the rights of the landless farmers,the specific design of the endowment insurance legislation for landless farmers is included,including the form of legislation and the rights of the subject of legal relations Obligations,sources of funds,operation,supervision,and rights relief methods responded to the issues raised in Chapter Two,and finally came up with suggestions for improving the legal system for endowment insurance for landless farmers.
