Comparative Study On The Work Safety Law In Kazakhstan And China

Work safety is an important part of any business activity,and people are defined as the main value because its safety and good health can make the production process more precise,thereby improving the profitability of the enterprise itself.Nothing is more important than protecting one’s health and life from threats.The number of hazardous work facilities tends to increase due to the huge breakthroughs in the hazardous materials industry.Industrial development has led to the need to increase and optimize safe living conditions and ensure population protection from harmful and dangerous factors.In order to solve the problem and ensure the safety of the people,various regulations have been adjusted in the field of work safety.Improving the regulatory framework is the basis for reducing accidents and injuries in public works.Each state regulates work safety based on its own experience and analysis of accidents at companies.As we all know,accidents at work are often disturbing and even paralyze the production of the company for a long time.This will not only cause tension in the team but also bring significant economic losses.The experience of the world’s largest companies shows that senior management considers ensuring work safety one of their top priorities.An appropriately organized work safety system manages workers’ occupational safety and health,thereby improving their work efficiency.Good governance and the rule of law are essential preconditions for the fulfillment of work safety supervision and management,without which societies cannot function.In recent years,the legal system of work safety has been continuously improved,which has played a significant role in strengthening work safety,preventing and reducing work safety accidents and occupational hazards,and protecting the lives and property of the people.The Work Safety Law has been enacted for the purpose of strengthening the supervision over law enforcement,preventing and reducing safety accidents,defending the safety of life and property of the masses,and promoting the development of economy.At present,China is in a critical period of industrialization and urbanization;it has made remarkable achievements because of the rapid economic growth.Behind the rapid economic growth,however,the costs are the frequent work safety accidents,social cost loss,ecological environment deterioration and so on,the above-mentioned elements caused not only massive losses of state property and civil life but also huge pressure of the public opinion of the international community,as a result,the supervision and regulation of work safety is particularly important.Under the condition of the free market,enterprises are the main body of responsibility to ensure the work safety,the improvement of work safety level should rely on the market mechanism.However,due to the differences in the legal framework of work safety,investment level of science and technology,social welfare treatment,education popularization,safety culture,and other factors,they are difficult to guarantee the work safety through spontaneous market behavior,which needs to rely on national supervision to achieve it.Kazakhstan is a developing country,where also a lot of attention is paid to work safety.Nevertheless,the accidents and ecological environment deterioration in Kazakhstan still remains at a high level.Compared with China,Kazakhstan has less experience in providing,supervising and controlling wok safety.The problem of work safety in Kazakhstan economy is a complex problem,which can be solved in several ways,among them the most important is the way to protect the employee by law from adverse working conditions.Revealing the advantages of one or another legislative system in the field of work safety will help in the future to review and improve the legislative framework of two countries.Therefore,this thesis provides a reference basis and theoretical support for the development and improvement of Kazakhstan’s supervision and regulation of work safety mode according China’s experience in this field.
