The Application Scope Of Work Safety Law

Work Safety Law was revised for the first time since it had been implemented for more than ten years.When affirm the practical significance and value of Work Safety law,it should also be deeply realized that application scope of the law is ignored.On the basis of analyzing the concept,content,significance of the application scope of law,the relationship between legal concept and application scope of Law,the relationship between Work Safety Law and Occupational Safety and Health Act,the primary problems of Work Safety Law can be summed up through text analysis,literature reviews,empirical and comparative research,including the space application scope being relatively narrow,the concept intension and extension of production and business units being unclear,production and business units as the resume of validity in terms of person being not enough,only protecting occupational safety having limitations and non-application provision being unnecessary.Through analyzing the reasons of these problems and learning legislation experience from other countries or regions,some specific suggestions are brought forward,for example,extending the space application scope of Work Safety Law,natural persons being regarded as production and business units,protecting occupational safety and health right of employee in public institutions,putting occupational health into the application scope to promote the integration process of occupational safety and health,deleting the non-application provision.
