A Study Of The Legal Issues In The Governance Of "Village Tyrants"

The village tyrant is a special product of the reform and development of our country.Village tyrants infringe on the legitimate rights and interests of rural villagers,disturb the order of grass-roots self-government,and hinder the process of grass-roots rule of law construction.In order to realize the integration of the rule of law country,the rule of law government and the rule of law society,we need to strengthen the construction of the rule of law in rural areas,improve the legal awareness of rural villagers,improve the grass-roots legal service system and the villagers' autonomy law,and improve the grass-roots autonomy mechanism.This paper aims to explore the legal path of governance of village tyrants,improve the organization law of villagers' committee,and improve the mechanism of villagers' self-government in China,and analyzes the current situation of research on Governance of village tyrants in China with the method of literature analysis.Secondly,starting from the concept,characteristics and harmfulness of village tyrant,this paper analyzes the economic,regulatory,cultural and institutional reasons for the emergence of village tyrant in China by using comprehensive research methods,and puts forward the legal dilemma of governance of village tyrant in combination with the status quo of relevant laws of village autonomy in China.Finally,on the basis of using comparative research methods to learn from the mature experience of American township autonomy mechanism,combined with the current situation of rural and farmers' rule of law in China,this paper tries to put forward the legal path for the governance of village tyrants in China.The main characteristics of this paper are to explain the causes of the village tyrants and the legal dilemma of governance respectively.It introduces the maturity of the American village autonomy from the two aspects of the organization of the village autonomy and the characteristics of the village autonomy.According to the current situation of the application of the villager autonomy law in China,it tries to study the legal path of the governance of the village tyrants from the two angles of the villager autonomy law and the criminal law,so as to improve the grass-roots autonomy system Fundamentally put an end to the possibility of village hegemony,protect the legitimate rights and interests of rural farmers,maintain the order of grass-roots autonomy,and promote the construction of the rule of law in rural areas.
