Study On The Professional Security System Of Judges

General secretary Xi Jinping put forward: "strive to make people feel fair and just in every judicial case." The court is the last defense line of social justice,and the judge is the gatekeeper of this defense line,and the supreme protector of social justice.Judges are the main undertakers of national judicial system and the actual executors of national laws.Their historical mission is to solve various social contradictions,maintain social justice and fairness,and also an important force to comprehensively promote the rule of law.In order to achieve judicial justice and implement the professional security system of judges under the judicial responsibility system,it is particularly important to strengthen the construction of the professional security system of judges.However,from the current situation,the system of judges' professional security in China can not fully meet the requirements of judges' professional development in the new situation.The Fourth Plenary Session of the 19 th Central Committee of the Communist Party of China put the comprehensive promotion of judicial system reform as an important task on the work agenda,and the reform of judge's professional security system as an important part of judicial reform has also attracted the attention of all sectors of society.At present,the judicial system reform led by the Party Central Committee has been carried out in an all-round way,and the idea of improving the judge's professional security system also needs to focus on the overall situation of the judicial system reform to conduct a comprehensive investigation and analysis.First of all,starting from the meaning and historical origin of the judge's professional security system,this paper expounds the necessity and significance of the judge's professional security system,including the protection of the judge's independent exercise of judicial power,the improvement of the judge's sense of responsibility and the improvement of the judge's sense of honor.Secondly,it analyzes the current situation and problems of the judge's professional security system,introduces the legal provisions of the judge's professional security system in China,combs the implementation of the judge's professional security system in China,and analyzes the existing problems of the judge's professional security system in China,including the limitation of the judge's independent judicial power,the defect of the judge's security system itself,and the right of the judge's immunity The power and responsibility are not clear,and the professional income of judges is not effectively guaranteed.Thirdly,this paper reviews the professional security system of judges in foreign countries,and briefly introduces the provisions of the professional security system of judges in the main countries of the common law system and the civil law system.Through the investigation,we can understand and analyze the achievements of the professional security system of judges in foreign countries.The experiences we can learn from include clearly stipulating in the constitution that judges exercise their judicial power independently,improving their social status,and implementing the high salary system of judges.Finally,some suggestions are put forward to improve the professional security system of judges in China,including ensuring the effective exercise of judges' power,improving the exemption system of judges' responsibility,improving the system of judges' salary and welfare,and strengthening the professional security of judges.
