Community correction is a method that does not isolate criminals from society and uses community resources to reform criminals.It is a general term for the way to supervise,manage and educate criminals in an open community environment.In the 1950 s and 1960 s,based on the theory and practice of returning to society,the socialization of execution,and improving the effectiveness of penalty,community corrections came into being in Western countries,and social participation is its core feature.Community corrections have been piloted in China since July 2003 and have gone through nearly 17 years.Finally,in December 2019,China promulgated the "Community Correction Law",which will come into effect in July 2020,and many of its provisions(Article 3,Article 6,Article 7,Article 11,Article 12),Article 13,Article18,Article 25,Article 35,Article 37,Article 38,Article 39,Article 40,Article 41,Article 56)You can see the regulations concerning the participation of social forces,It is the importance of social power in community correction work is clearly defined by legislation.The promulgation of the "Community Correction Law" not only means that our country's community correction work continues to have a comprehensive legal basis and system guarantee,but also marks that our community correction has entered a new stage of development.In some western countries,the participation of social forces in community corrections is widespread.For example,in the United States and Japan,there are many social organizations and a large volunteer team participating in community corrections.Whether it is legislation or practice,the participation of social forces has been relatively mature and perfect.In the practice of community corrections in China,with the implementation of the "Community Correction Implementation Measures" in 2012,the "Opinions on Organizing Social Forces to Participate in Community Correction Work" in 2014,and the "Community Correction Law" in 2019,the participation of social forces has become a At the same time as important topics,it has been widely valued and put into practice.Generally speaking,the participation of social forces in community correction work in China is still in the stage of continuous exploration and improvement.Although some experience has been accumulated and some results have been achieved,it also faces many problems that need to be resolved urgently.The uneven participation of social forces in the central and western regions and so on.This article is divided into 5 parts,mainly using the methods of literature research and empirical research.Based on the definition of core concepts,the current practice of social power participation in community correction in China is summarized and summarized from the perspectives of legislation and practice,and the problems of social power participation in community correction are analyzed.By investigating the practice of social forces participationin developed regions abroad,and learning from relevant experience,we try to put forward suggestions for improving China's social forces participation in community corrections.
