Research On Social Participation In Community Corrections

Social participation is the essential feature of community corrections.The "Community Corrections Law" constructs a relatively complete institutional framework for social forces to participate in community corrections from the aspects of participating subjects,participating objects and participation methods.The research on social participation in community corrections needs to be carried out from the two levels of academic theory and practice in accordance with legal regulations and related practices,starting from the legal background,institutional background and experience background of social participation in community corrections.The problems of social participation in community corrections can be summarized as: the non-standardization of social participation is mainly manifested in the insufficient implementation of legal norms and the imperfect operation mechanism;the formalization of social participation is mainly manifested in the obvious transitional color of participation and insufficient obligation of participants;the unity of social participation is mainly manifested in the unity of participants and content.The current participants are mainly grassroots organizations,and the content of participation is often limited to the level of education and consulting services.The factors causing the social participation problems in community corrections mentioned above can be analyzed from three levels: technology(operability),system(normative)and culture(ideal).The technical level means that the specific operating procedures are not detailed enough,and the summary,analysis and sharing of operating experience are not strong enough;the system level refers to the insufficiency of the organizational system and guarantee system;the cultural level includes two aspects of social cognition and social psychology,mainly referring to the people,that is,the deviation of social forces' understanding of the attributes of community corrections and the people's insufficient understanding of the meaning of social participation.These three levels complement each other: Technology focuses on specific actions,system is the structural environment of action,and culture is the common foundation that supports the former two.Therefore,in terms of importance,technology is superficial,system is deep-seated,and culture is soulful.Through the above analysis of the status quo and causes of social participation in community corrections,the problem of social participation in community corrections can be based on the integration of constructive community corrections concepts(cultural level)and generative community corrections experience(technical level),Try to solve it by further improving the relevant system(system level)of social participation in community corrections.On the one hand,community corrections are an important manifestation of modern penal concepts.Theunderstanding of community corrections and social participation needs to be carried out in the context of modern penal concepts;on the other hand,the experience of community corrections includes all kinds of extraterritorial experiences as well as rich and diverse local experiences,which are solid soil for solving practical problems.Under the two-way interaction of the above-mentioned concepts and local experience,the construction of the system can be continuously strengthened,including the establishment of rules and regulations in terms of the access and exit mechanism of social forces,the participation responsibilities of social forces,participation procedures and participation guarantees.Only in this way can the problem of social participation in community corrections be effectively and fully resolved.
