Tobacco plays an extremely important role in people's social life.Especially in modern times,cigarettes have become an indispensable "important partner" for successful people.Tobacco enterprises have also become a very fast tool for making money.According to statistics,the profits of tobacco enterprises in various countries can almost equal the national military expenditure.Input,this is a very amazing number.However,with the deepening of medical research,the harm of tobacco products to human beings has gradually attracted the attention of the public and even the government.The annual losses caused by tobacco in the contemporary world can also be called astronomical figures.To this end,countries have introduced laws and regulations such as tobacco control and banning tobacco advertising,hoping to minimize the harm of tobacco products to the public.The main content of this paper is to sort out the legal regulation system of tobacco advertisement in our country,and put forward my own opinions on the improvement and promotion of tobacco advertisement supervision in our country.In order to make the article clearer,the main structure of the paper is as follows: Firstly,from the definition,characteristics and classification of tobacco advertising,this paper elaborates the relevant characteristics of tobacco advertising in China;Secondly,it defines the relevant theory of legal regulation of tobacco advertising,and introduces the legal regulation of tobacco advertising respectively.Relevant content,characteristics of legal regulation of tobacco advertisement and its necessity of existence lay a theoretical foundation for the creation of the paper;Third,analyze the current situation of legal regulation of tobacco advertisement in China,and analyze the causes of the existing problems of legal regulation of tobacco advertisement in China from the angles of legislation,law enforcement and society;Fourth,compare the present world.Several main types of legal regulation of tobacco advertising,such as the strict type in Panama,the moderate type in Japan and the parallel model of central and local regulations in the United States,summarize the advantages and disadvantages of these countries in the field of legal regulation of tobacco advertising,and conclude that Panama and the United States can take advantage of the prohibition of tobacco advertising.One of the most important reasons for such outstanding achievements is the importance attached to the construction of the legal system,while Japan's relatively moderate legal system has been criticized by the international community.Fifth,it puts forward some suggestions on the construction and improvement of the legal regulation system of tobacco advertising in China.Discusses the perfection of legislation,the strengthening of law enforcement and the promotion of the self-discipline of tobacco associations.The sub-arguments of perfection of legislation include the construction of a sound regulatory legal system,the clarity of the subject of responsibility,the continuity of various laws and regulations and the openness of government affairs.On the one hand,the sub-arguments of the section on strengthening law enforcement include actively promoting the deepening reform of regulatory functions,strengthening the supervision of tobacco sales terminals,and strengthening the supervision of various regions.In the end,the author summarizes the creation of this article and puts forward that tobacco enterprises should try their best to incorporate all kinds of advertising behavior into the supervision of laws and regulations.In view of the "invisible characteristics" of new media advertising on the Internet,this paper puts forward some countermeasures,such as strengthening network supervision and establishing an open platform.On the basis of perfecting the legal system,we should truly "abide by the law",strengthen the supervision of various types of tobacco sales terminals,and keep close attention to the emergence of new advertising.It is also inseparable from enhancing the self-discipline of the tobacco industry as a supplement to take the legal enforcement force as the main force for supervision,which can neither dry up but fish,nor properly coordinate the interests of all parties.Finally,the future research directions are put forward.
