An Empirical Research On The Duty Crime Of Criminal Investigators

On May 8,2019,Xi stressed at the National Public Security Work Conference that under the new historical conditions,public security organs should "adhere to the overall strict control of the police." Always maintain "zero tolerance" for disciplinary violations.Whether it is "tiger","fly",or black evil forces and other illegal crimes of the "umbrella",should be seriously investigated and dealt with in accordance with the law.Public security organs play an important role in maintaining social stability,ensuring people's well-being,enhancing their ability to govern socially,and promoting the construction of the rule of law in the country.The corruption and bribery,fraud and torture and other official crimes existing in the investigation team undermine the seriousness and impartiality of the law,infringe on the legitimate rights and interests of the people,damage the credibility of the Party and the government.And to some extent,offset and erase the efforts made by the investigators of the public security organs to fight crime and protect the people.Facing the serious duty crime situation inside the investigators,how to improve the ability to perform their duties according to law and build a fair and civilized law enforcement,is an important theoretical and practical significance of the subject.This study exams the behavior characteristics,investigation procedures,legal liability,investigation dilemma,extraterritorial governance reference and anti-defense countermeasures by taking the typical cases of refereeing documents and news reports as a sample.The concept of investigator and investigator's duty is lack of unified understanding of law and academic circles,and it is necessary to make a clear scope from both the legal provisions and practical work,and then try to define the criminal duty behavior of the public security organ investigators more appropriately.The criminal judgments of the investigators involved in public security organs from 2010 to 2019 were collected and analyzed.The paper further excavates the specific characteristics of the three categories of crimes of corruption,bribery,malfeasance and infringement of personal and property rights.On the basis of the second part of statistics and analysis,the third part summarizes the difficulties of the investigator's duty management.Mainly from the investigator sub-cultural influence,insufficient investigation supervision and investigation subject generalization caused by the expansion of the risk of investigation power,in order to exploring the public security organs to investigate the crime of crime case management of the crux of the problem.In part four,the study selects Singapore as an extraterritorial research sample,analysis of its investigation agencies set up,investigators management,curb the specific measures of duty crime,how to work to control the investigation of corruption and abuse of investigative power,to create a world-renowned,clean police force.In the end,the study explores and constructs a perfect system of crime management for the investigators of public security organs.
