Labor relations are the most basic social and economic relations.A harmonious labor relationship which means a good state between employers and employees is the basis for stable social operation.The party and the government have always attached great importance to the construction and maintenance of a stable and harmonious labor relationship,which is closely linked to the current status of labor relations.Since the reform and opening up,the continuous outbreak of conflicts in labor and capital in China has aroused widespread public concern.This poses a severe challenge to the solution to the labor dispute.How to construct a labor relationship that is compatible with economic development and promote the stable development of the society is a practical issue that is worthy of consideration while maintaining the sustainable development of the economy.Based on the research background and the reality,this paper constructs the theoretical system of the labor dispute influential factors under the guidance of the theory of labor supply and demand,human capital theory,the influence of population changes on labor supply and the theory of labor unions,and uses the panel data of 30 provinces from 2003 to 2015 to do empirical test combined with case studies to study the status of labor disputes and influencing factors.First,analyze the status of labor disputes.It is found that as the economy grows the number of labor dispute cases is gradually increasing which has caused widespread concern in society in recent years.Labor disputes are mainly caused by the fact that employers and employees can't reach agreement on labor remuneration,social insurance,and the cancellation of labor contracts.The results of the case analysis are consistent with what the data shows.The laborers themselves have a weak sense of law and the low rate of signing labor contract can also lead to labor disputes.Since the labor unions did not properly represent the interests of the labor and the government did not take effect on organization and supervision in the consultation and mediation between employers and employees,resulting in further expansion of the contradictions between the employers and the employees,and finally having to resort to law.In order to further study the influence of various factors on labor disputes,a multivariate regression econometric model was constructed to do empirical tests.The regression results show that the increase in the dependency ratio,the education level of laborers,and the urbanization rate are all conducive to the reduction of labor disputes and the increase in the average salary of employees and the number of union organizations in various regions will increase labor disputes.Although dependency ratio is negatively related to labor disputes,as China's aging process accelerates and demographic dividends gradually disappears,labor supply is facing severe challenges,which is not conducive to the sustainable development of the economy in the long run,so the state should continue to implement "comprehensive two-child" policy and improve related supporting facilities to provide adequate manpower for economic development in order to ease the tense labor relations;In addition,it is necessary to enhance the legal awareness of laborers and strengthen the skills training for laborers;Raise the cost of illegal businesses and the probability of investigation and prosecution;Give full play to the main roles of the tripartite consultation mechanism to effectively prevent labor disputes.
