Study On The Mode And Improvement Of Chinese University Corporation Governance

The governance model of public colleges and universities is a mode of management and control of the organization body of public colleges and universities.It includes the means and methods of various kinds of subjects within the University,the integration of various resources within the University,the means and ways to straighten out various relations within the University,as well as the relationship between the University and the external environment and the rules of the system..However,the traditional positioning of public university legal person can not meet all the requirements in judicial practice,and it is urgent to redefine the status of public universities in administrative law.In the internal governance mode of colleges and universities,there are some problems,such as imperfect institutional setup,lack of vitality in personnel system,absence of substantive laws and generality.In the external governance mode,the relationship between University and government is mainly involved.Due to the strong position of the government in the field of higher education in China,the government should play a role in the macro power,which makes the public universities in the position of being managed and controlled.The two forms a serious dependence relationship,which makes the corporate governance mode of public universities lack flexibility.In view of the rich theoretical and practical experience of Japan in the legal person governance of universities after the reform of national universities,this paper analyses the effective measures of the legal person reform of the Japanese national colleges and universities on the basis of the analysis of the corporate governance model in China's colleges and universities,and puts forward the corresponding solutions.The first two chapters discuss the reform experience of the legal person of University,the perfect study of Chinese University Governance Model and the identification of the legal person status of Chinese public colleges and universities.To clear the corporate governance model of the public universities in China,it is necessary to make clear the legal status of the Chinese public universities.As for the identification of the status of public university legal person,there are many opinions in academic circles.The author starts from the traditional orientation of public universities and institutions,and further explores the legal position of institutions of higher learning in administrative law.Then through the bottleneck and challenge of the juridical cognizance in the juridical cognizance of the University,it reveals the necessity of drawing lessons from the reform experience of the legal person of the National University of Japan.The third chapter starts from the connotation of corporate governance in public universities,and points out the current situation and defects of corporate governance in Universities from two aspects,internal and external.On the micro level,in terms of the internal structure of colleges and universities,it is pointed out that there are some problems in the internal structure of colleges and universities,The personnel system needs to be reformed.In terms of the external structure of universities,the relationship between universities and the government is emphatically analyzed.As a running scholar of public universities,the government hinders the development of higher education in many ways.The fourth chapter focuses on the analysis of the governance model of the National University of Japan.In the same way as the third chapter,it is also analyzed from the two aspects of the internal and external modes of the University.It can be more intuitively contrasted on the progress of the concrete measures of the reform model of the Japanese national universities.In the last chapter,by comparing the reform measures of Japanese Colleges and universities,the corresponding solutions and thoughts are put forward in view of the problems analyzed in the first three.First of all,I hope to draw on the theory of corporatization reform of Japanese national universities to develop the theory of Chinese administrative subject,so as to relocate the status of Chinese university legal person.Secondly,from the following three specific aspects to enrich the theory of corporate governance in public colleges and universities in public colleges and universities in China.The first is to clarify the governance pattern within the university through the constitution.The second is to remove the administration of University Management,and put forward how to speed up the process of the administration of the public universities.
