Research On The Intervention Of Social Work To The People's Mediation Of Divorce Dispute

Since the reform and opening up,the divorce rate in China has been rising steadily.The mediation of divorce disputes has become an important part of people's mediation work.As the concrete undertaker of the people's mediation work,the people's mediators shoulder the responsibility and mission of resolving contradictions,propagating the rule of law,maintaining stability and promoting harmony.According to statistics,people's mediation has a downward trend in the mid-1990 s.The number of mediators and mediation disputes is decreasing year by year.Civil litigation has gradually become the main way to solve civil disputes in Chinese society.The structure of dispute resolution has the characteristics of "strong litigation,weak mediation".People's mediation,once praised as the "Oriental Flower",has gradually degenerated into "Yesterday's Yellow Flower".This provides the possibility for the intervention of social work.The flexible mediation of professional social workers is more gentle and acceptable.It can also help people to play a better role in mediation.People's mediation work needs to constantly adapt to the needs of social development under the new situation,eliminate minor contradictions in the embryonic stage,and social workers can use professional knowledge,skills and methods to participate in mediation cases.On the one hand,to a certain extent,it broadens the areas and scope of social workers involved,and at the same time,it helps people's mediators to improve the quality of work and extend the breadth and depth of people's mediation work.On the other hand,it can also optimize the public judicial resources of courts,minimize the burden of litigants,and make positive contributions to maintaining social harmony and stability,serving and improving people's livelihood.The author will take four cases as an example,focusing on the analysis of the shortcomings and advantages of social work specialty in the field of interacting with government agencies in mediation,further analyzing the possible areas involved in expanding social work,summarizing how to establish a benign mechanism for social workers to participate in and assist people's mediators in resolving contradictions and disputes,and enhancing the role of people's mediation organizations in playing the "first line of defense" at the grass-roots level.And reflection.
