Researching On The Organization Guarantee Of Teachers Academic Rights In University Charters

As the "constitution" within colleges and universities and the normative documents to protect the rights of university teachers,the academic rights of teachers need to be protected in the University Charter.This paper attempts to make research on the relevant provisions of the University Charter on the organization and protection of teachers' academic rights,to explore whether these provisions can guarantee the academic rights of university teachers? Its purpose is to further improve the relevant provisions on the organizational protection of teachers' academic rights in the articles of association of colleges and universities in China.This paper mainly adopts the text analysis method to construct the overall analysis framework system from the connotation of the organization and analyzes the articles of association of 9 universities from the static and dynamic dimensions.From the static dimension,this paper mainly analyzes whether the academic organizations specified in the University Charter can provide corresponding protection for teachers' different academic rights and whether the academic responsibilities of academic organizations at all levels specified in the University Charter text match with their academic authority.From the dynamic dimension,it mainly studies the generation and operation of academic organizations.The generation part of academic organization mainly studies the relevant provisions of academic organization formation in the University constitution from the formal legitimacy and substantive legitimacy of academic organization generation.The formal legitimacy mainly studies whether the regulations on the generation of academic organization in the articles of association of colleges and universities meet the requirements of procedural participation and procedural neutrality,and the substantive legitimacy mainly studies the Middle School of University Charter text Whether the formation mechanism of technical organization conforms to the purpose of academic organization of "advanced knowledge".The operation of academic organizations is mainly studied from the decision-making mechanism and system control of academic organizations.The decision-making mechanism of academic organizations mainly studies the decision-making process mechanism,decision-making implementation mechanism and decision-making coordination mechanism of academic organizations to protect the academic rights of university teachers.The system control of academicorganizations mainly focuses on the text of University charters This paper analyzes the information feedback mechanism,accountability,and relief mechanism of academic organizations.Through the text analysis of nine university charters,it is found that,from the static dimension,the academic organization structure is not complete,the function is not matched,and the authority provisions are not complete and the authority is not equal among all levels of academic organizations;from the dynamic dimension,the University Charter text has the problems of too strong administrative power and the main category of academic rights in the process of academic organization generation,Besides,the decision-making mechanism and control mechanism of academic organizations are not perfect and specific.Based on the above problems,this paper attempts to put forward suggestions for further revision and improvement of the University Charter text,including: first,the system and revision of university charter should fully respect teachers' academic rights;second,clarify the content of academic rights,improve the corresponding academic organizations,further improve the functional orientation of academic organizations,and straighten out the authority relationship among academic organizations at all levels The framework structure of academic organizations;the third is to solve the problem of administrative power process and clarify the subject category of academic rights to further improve the formation mechanism of academic organizations;the fourth is to further improve the decision-making mechanism and control mechanism of academic organizations,to further improve the operation mechanism of academic organizations.
