In the long history of mankind,social productivity and the level of political,economic,and cultural development have long constrained the special children's right to access education.They have been individually deprived of their right to participate in education and their beneficial right because of their disability,and have received inappropriate evaluations,classifications,and placements.After the middle period of the 20 th century,with the gradual maturity of industrial civilization in the world,education equity has gradually become the core value and basic goal of educational modernization as an extension of social equality value in the field of education.The issue of the right to access education of special children has become one of the core topics of education equity in the world.The United States has made outstanding contributions to the recognition,emphasizing,and safeguarding of the equal rights of education for special children in the world in the process of actively exploring education fairness.The main path of its realization is that the federal government of the United States constantly researches,formulates,and implements all kinds of bills related to special children,which has formed a distinctive legislative assurance system for the equal rights to access education of special children in the United States.What is the social background and cultural foundation of the legislative assurance system for the equal rights to access education of special children in the United States? How has the legislative assurance system for the equal rights to access education of special children in the United States developed in the context of historical development? How does the process of legislative assurance system for the equal rights to access education of special children in the United States evolve? In the process of ensuring the equal rights of special children in the United States,what is the meaning of the right of equality to access education and how has it been changed? What are the characteristics of the legislative assurance system for the equal rights to access education of special children in the United States?To deal with the issues mentioned above,the paper focuses on the evolution of the concept of “equal rights” and the social development reflected by the legislative guarantee process,legislative content,legislative measures and legislative processes of the special children education in United States.The study includes the following sections:The first chapter clearly points out the study purpose of the research on the equal rights of American special children education,analyzes the situation of domestic and foreign research and the equal rights of American special children education law,and introduces the core concepts of special children,education equality,and special education legislation.Also,this chapter establishes the purpose,contents,methods,conception,frame,and innovation point of this study.The second chapter introduces the history,background,content and measure of legislative guarantee,and periodical connotation of the stage of equal but isolated special children educational equal rights.This stage was the first stage of the legislation guarantee for special children education equal rights in the United States,and it produced special legislation of equal rights for special children's education and finished the development process of legislative guarantee'sequality of educational opportunity,which was described as “inside of the school gate” and “beyond of the mainstream”.It is noteworthy that,at this stage,the background of American social development fundamentally determined the “compensation logic” of special children educational equal rights.The third chapter introduces the historical and educational background,content and measure of legislative guarantee,and periodical connotation of the development stage(return to the mainstream).At this stage,with the rise of the concept “mainstreaming” and the occurrence of some judicial precedents,legislative guarantee's response to the concept of “return to the mainstream” is further dived.Breaking isolation,realizing coalesces,and legislative guarantee of “equal education process” under the circumstance of minimum limitation are the goals of this stage,however,formalizing problems also occurred.The fourth chapter discusses the historical and educational background,content and measure of legislative guarantee,and periodical connotation the formative stage(inclusive education)of equal rights legislation of the special children's education in the United States.At this stage,the legislation guarantee for special children education equal rights in the United States responds to the concept of “inclusive education”,and it further enacts bills to show its identity and demand of “equal educational result”.The fifth chapter vertically combs the first three chapters,and horizontally explores the characteristics of equal rights legislation of special children's education in the United States,which aims to deepen the understanding of the legislation guarantee and the relation between the meaning of “equal right” and its primary soil.Firstly,in the legislative process of equal rights for special children's education in the United States,the check and balance between national rights and civil rights is the fundamental strength of its development.Secondly,the due process demonstrates the spirit of legitimacy and justice to ensure the universality and enthusiasm of the participation of the public for the education of special children.Finally,“project doctrine” is a feature of the legislative safeguard of equal rights for special children's education in the United States.Project management plays a great role in promoting the evolution of equal rights for special children in the United States.In short,the special education legislation of the United States is a complex “ecosystem”,in which the history and process of “equal rights” are the seeds,the history and social development are the soil,the democratic culture is the nourishment,the continuous research and paradoxical movement are the light,and law and funds are the water to guarantee its development.The legislative guarantee of the right to equal education for children in the United States has emerged in the field of special education research in the world as a “mature organism”,and the understanding,judging,absorbing and imitating of it must develop in “primary soil”.
