The land has the function of economy and security.It not only provides the essential material for the development of agricultural production,but also can guarantee the basic life of the peasants.No matter how the economy develops,the exploration of the reform of the land system has been moving forward,because the reform of the rural land system is directly related to the development of the entire national economy.Since the contracted land circulation was put forward in 1995,large-scale management of land has come into shape,especially in the construction of new urbanization and the "Internet plus" background,ways and subjects of circulation have been increasingly diversified,circulation system tends to be perfect.Thanks to that,farmers have been liberated from the shackles of land,no longer attached to the land of life.The household contract responsibility system brought much benefits to the farmers in the land tenure,use,income and other aspects of the rights,likewise,the contracted land circulation achieved certain results in increasing the income of farmers and promoting the adjustment of agricultural structure,but there are still some problems in the process of land circulation.Due to the vast territory in our country,land circulation situation varies according to different region and different terrain,different stage of development.In current academic fields like jurisprudence,sociology and economics,their main concerns include the issue of ownership,some problems and solutions about the imperfect circulation system,the improper functions played by government in the process of transferring land contract management right.However,there are few studies which study the contracted land circulation problems and the relationship between urban and rural areas based on the Marx doctrine the theory,still fewer in carrying out the empirical analysis of contracted land circulation of different regions and stages by comparative method.Therefore,this paper is a study of the transfer of the contractual right of land in the process of urbanization by using research methods like classification and comparison.The research covers the north and south,farmland and forest,plain and mountainous areas,urbanization and non urbanization.The combination of theoretical analysis and empirical analysis is more favorable to the study of the circulation of land contractual management right in the process of urbanization.Based on Marx's land ownership(property rights)theory,Marx's theory of land rent,the Marx doctrine theory and Marx's theory of the relationship between urban and rural development in China,through the review of the evolution of the policy in land contractual management right,This study pointed out that the contracted land management right has important practical significance for the construction of urbanization.From different perspectives,respectively using the Northern Plain Farmland mainly in Shangcai County,Henan province in southern mountain forest in Youxi County,Fujian Province in the process of urbanization in the urban fringe of Minhou County of Fujian Province as an example,this study describes the current status of contractual operation right of land circulation in China and analyzes the problems and causes of these problems in process of the contracted land circulation.Based on the above,in view of the practical experience of foreign countries and its enlightenment to our country,it puts forward the countermeasures to improve the circulation of land contract management right.This paper has systematically analyzed the effect and the main problems in the process of transferring land contract management right in different areas,and try to analyze the causes and put up with the countermeasures of the problems,but there are still some deficiencies.Because of the differences between regions of China in the natural conditions,economic development level,geographical location and location advantages,this research can not cover all the problems in transferring land right,and even the success of the pilot mentioned in this example should also be combined with local real condition to get promoted.
