Research On The Right Of Rural Area Land Contract Management Right

The "nineteen major" reports put forward the "implementation of the strategy of Rural Revitalization" and put the problem of "three rural" as the most important task.We should deepen the reform of rural area land system and improve the "three rights" division system of the contracted land.Deepening the reform of the rural land system,the right of the land contract management right is the basic work.It is an important prerequisite for the implementation of the "three rights" separation system and the important guarantee for the maintenance of the land contract and management rights of farmers according to law.In 2011,Heyuan was one of the 50 pilot counties(cities and districts)for the registration of land contracted management rights in the country,which was undertaken by the Ministry of agriculture to register the contracted management rights of rural area land.The paper takes the ShuangXia-village of Po Qian Town of Heyuan city,Guangdong Province as the research object,and analyzes the problems in the right work of the rural area land contract management right,which is helpful to provide reference for the work of other areas and the national decision.Based on practice and practical work,this paper deeply investigates and studies the problems existing in the land right of ShuangXia-village,analyzes the reasons,and puts forward the corresponding countermeasures.At first,the paper expounds the background,significance,research status and research methods of the right of rural area land management right,and introduces the relevant concepts and theoretical foundations of the right of land contracting management right.ShuangXia-village as an example,it describes the present situation of the work of the right to carry out the right of land contract management in ShuangXia-village.As a result,the right foundation of the contracted land is not firm,the implementation of the right of land contract management right is not in place,there are many disputes on the ownership of land,and the effect of the right of land contract management is to be tested.On this basis,the paper provides further insight into the reasons leading to the above problems.Finally,it puts forward practical suggestions for the existing problems.
