The Research Of Circulation Mechanism For Qingdao Rural Land Contractual Management Right

At present, China’s rural society is undergoing profound changes. Land resources as amajor means of production in agricultural development, rural land contractualmanagement right transfer has become a focus of community attention. Theestablishment of circulation mechanism for rural land contractual management rightwill play an active contribution in rationalizing the agricultural production relations,protecting the food security and effective supply and maintenance of the legitimateincome of farmers, and so on.Focusing on the circulation problem and circulation mechanism establishment, thepaper conducts an in-depth study on rural land circulation courses and problems inQingdao. Combining with some of the world’s advanced experiments in othercountries and regions, aiming at the actual situation of Qingdao, the paper putsforward a set of operating suggestions on construction of circulation mechanism forQingdao rural land contractual management right.The paper is organized as follows:Chapter Ⅰ, introductory chapter, mainly to introduce the research background andsignificance, comb the concerned domestic and foreign literatures, and state theresearch methods and specific research ideas in this paper.Chapter Ⅱdescribes the core concepts and basic theories about circulation mechanismof rural land contractual management right. The core concepts include rural land, ruralland system, rural land contractual management right and circulation of rural landcontractual management right, etc. The basic theories include Institution ChangeTheory, Land Rent theory, Large-scale Land Management Theory, and PropertyRights Theory. The clearance of these basic concepts and theories has laid atheoretical foundation for the following further research.Chapter Ⅲ introduces the development process of the rural land contractualmanagement system home and aboard. Part one introduces the history and thedevelopment of circulation system for rural land contractual management rights in ourcountry, and obtains the revelation based on the analysis of China’s agricultural landuse right transfer; Part two mainly introduces the rural land transfer background,practices and effects of the United States, Japan and Taiwan, and made a useful inspiration for the establishment of China’s rural land circulation mechanism.Chapter Ⅳ introduces the Qingdao rural land contractual management rightcirculation mechanism, mainly from the details of the development process, transferstatus and flow characteristics of Qingdao rural land contractual management right.Chapter Ⅴ combs the problems in Qingdao rural land contractual management rightcirculation, and analyses the cause of the problems, including the problems related tothe lake of legal consciousness of transfer main body, resulting in increasedtransaction costs; also the problems related to the non-matching supportingmechanism impacting the supply of land transfer, and other problems such as landtransfer market is not perfect, poor circulation and other information channels. Themain factors to affecting the development of Qingdao rural land contractualmanagement right circulation include the rural land system-level factors, theagricultural land market-level factors, and the farmers’ knowledge recognized andwillingness-level factors.Chapter Ⅵ on the basis of the above studies, combined with the actual situation ofQingdao, put forward suggestions about establishment and perfecting the circulationmechanism for Qingdao rural land contractual management right, include,standardizing and improving marketing operation in the transfer market field, enactingand perfecting the concerned laws and regulations in law protection field, improvingthe social service supporting system and security system in social security field, andpositioning the government’s macro-control, supervision and management functionsaccurately in government function field.Chapter Ⅶ summarizes the main findings of the paper.
