Comparative Analysis Of The Circulation Modes Of The Right To Use Homestead In Rural Areas

Homestead in rural areas is an important part of rural land,it is a collective land used by rural farmers or individuals for residential use,farmers have the right to use homestead.On the one hand,the transfer of the right to use the rural homestead in China is limited by the law,causing a large number of homestead idle,"hollow village" phenomenon;On the other hand,the demand for land resources in the urbanization process is growing.In order to intensively utilize the land and optimize the allocation of resources,our country has issued a series of policy documents on the reform of the homestead system since the beginning of the 2004 issue of the "National Development [2004] No.28" document to the Central Document No.2017,to strengthen the legitimate transfer of rural homestead use rights,and under the guidance of the central policy,all around are actively exploring the effective transfer of homestead use rights pilot.This paper summarizes the existing pilot model of the right to use the right to use homestead,according to the transfer of the price of the main body of its classification,divided into government-led,market-oriented,peasant collective-led three circulation model,combined with the theory of institutional change,it analyzes the institutional change motive and the system supply subject of each mode,and make a conclusion that the institutional change path of the government-led and market-oriented circulation model is the path of the mandatory institutional change,and the peasant collective-oriented circulation model is the conclusion of the induced institutional change path,combined with the flow of pilot cases on the three models,compared the operating mechanism,cost sharing and income distribution,from the institutional environment,the system content and system efficiency to sum up,from a different point of view,different flow patterns,strengths and weaknesses are different,therefore,in the context of the current national conditions,should be due to local conditions and prudent and prudent homeland use rights transfer pilot,and through the relevant policies to improve the various modes of circulation to ensure that the interests of farmers,thus promoting the transfer of homestead use rights.
