In recent years,with the rapid development of the local industry,soaring house prices much faster than the size of the residents' income growth,leading to more and more people can't afford to buy a house,at the same time,the national housing system is not perfect,unable to meet the real needs of society,the housing difficult also has become an important issue affecting the livelihood of the people in our country,under this background,the small property right arises at the historic moment.Based on the existing urban and rural land system in our country,the construction of the small property right does not need to apply to the department in the land,pay the land grant fee and other relevant taxes,compared with ordinary commercial housing,construction costs low makes it has unique advantages in terms of price.Although small property right belongs to the illegal built,not like the ordinary commercial housing to get related certificates issued by the property right card to room canal branch,but under the realistic demand for housing and economic pressure,small property right or the lower income groups,their buying team growing.Market demand,does not meet the existing collective land revenue,make the rural collective organizations are also suit for the development and construction of small property right as a result,the small property right and the major in our country,the city spread.In this regard,the state has repeatedly issued a statement on its illegality,the sale of small property rights,and the cleaning of small property rights in multiple cities,with little effect.The problem of small property ownership is difficult to solve,besides the large number of construction and extensive distribution,it also comes down to the interests of many social groups in its long-term development.The problem of small property ownership is not solved,and the long-term disruption of market order will seriously affect the coordinated development of China's social and economic construction.Due to the improper handling of the small property rights room and the interests of the group behind it,it is likely to arouse new social contradictions.Therefore,in the process of solving the problem of small property ownership,it is necessary to start from the root cause and balance the interests of all parties and seek a reasonable and long-term effective way out.Based on the comprehensive analysis of small property,this paper focuses on the reform of rural land proposed by the third plenary session of the 18 th CPC central committee,and explores the feasible way for the governance of the small property right room in this background.The paper is divided into five parts:The first part is mainly about the concept of the small property right,a clear definition of comprehensively,to distinguish it from the difference between commercial housing,the housing prices and market demand,imperfect system of comprehensive analysis of the historical cause of small property right;The second part mainly discusses the present situation of the development of the small property right room,and analyzes the existing legal dilemma of the small property house from the aspects of current legal regulation,property rights and creditor's rights.Third points is mainly for the present stage has been put forward,the essay discusses the small property right management way,respectively,it is pointed out that the demolition of the legalization of small property right fully,at the same time,into the housing safeguard measures such as don't have the feasibility in practice,in view of the latest collective right of rental housing and rental with the pilot,analysis on the small property right management and can't play a substantial role.Finally,it is suggested that the management of small property rights should be reformed from the root cause.The fourth part mainly elaborates the construction land of collective management,and realizes the same right with the state-owned construction land.To define the concept of the same rights and to analyze the feasibility of the same rights realization,and put forward the idea of its establishment.The fifth part mainly discusses the right,at the same place and build the small property right cure should insist on cultivated land protection,the basic principles,such as to distinguish the governance and finally put forward the basic principles of governance under the specific measures...
