Research On The Improvement Of My Country's Construction Project Environmental Impact Assessment System

In March 2015 the Ministry of Environmental Protection released "from the national environmental protection system of assessment agencies work plan',the provisions of construction project EIA agencies to undertake the business of the national environmental protection system will be completely decoupled and the original units by the end of 2016,during the July 2016 "Environmental Impact Assessment Law" has been revised,in a series of environmental heavy,EIA market the reform of construction project from the call into reality.This paper takes Hangzhou EIA corruption and fraud cases for the Jiangxi Kowloon gypsum EIA,analyze the background of reform of assessment agencies market,China's construction project EIA system does not solve problems and suggestions.In the first part,the basic structure on our construction project EIA system and main function,analysis of relationship between the main part of the EIA.In the second part,taKing the case of "Hangzhou environmental protection system corruption"as an example,the negative-influence of the benefit chain between the environmental protection agency and the EIA Department on the environmental impact assessment system of the construction project is discussed.Introducing the basic situation of the market reform,the legal background,the process of the reform and the positive effect of the market reform.The third part,through the analysis of "Hangzhou EIA corruption case" and "Jiangxi Kowloon gypsum mine EIA fraud case,construction project EIA system with the analysis of the construction project EIA agencies market reform situation there are still many problems,for example,constraints of the construction unit of the EIA mechanism is weakening;the existence of hidden reform does not fundamentally solve the public participate in formal problems and the construction project EIA system overall supervision system.Finally,the fourth part of the thesis,put forward the construction project EIA institutions in the context of market-oriented,should improve the construction project environmental impact assessment system,including improve the quality of examination,strengthen the supervision of the construction project EIA subject,forced the EIA institutions to improve the quality of EIA,the introduction of administrative guidance,promote the construction project EIA public participation and the establishment of the essence the interested party EIA objection system to strengthen the external supervision project eia.
