Research On The Amnesty System In The Period Of Beiyang Government

The founding of the Republic of China,the old system showed a thousand things wait to be done,the new historical features in the new era.As one of the oldest institutional traditions in China,the amnesty system has shown new historical characteristics after entering the Republic of China.First,based on the Constitution and laws,it becomes an important part of the national system.Secondly,from the implementation body to the operation procedure,there is a clear system standard.The legal builders in the Republic of China have designed a set of relatively perfect amnesty system,but the good system can not always carry out the original intention of the designer,and become the cornerstone of democracy and the legal system of the Republic of China.This paper selects the representative Yuan Shikai and the partisan people's pardon,Liang Shiyi's amnesty case and Zhang Xun's amnesty case as reference cases.On the basis of the condition of its system operation and execution,the interaction between the amnesty and the amnesty of the movement is the investigation point,trying to restore the operation of the amnesty system during the period of the northern government.
