Human cannot be satisfied,and the overall demand for society is also infinite.We should not only pay attention to whether legislation can promote the effective allocation of resources and maximize the total wealth of society,but also pay attention to the process from the perspective of ethics.Legislative activities cannot escape the logic of collective action,usually in a state of imbalance-a small number of people get benefits from the legislation,others from the obligation of the legislation.The public choice theory,the methodology of individualism,rational person hypothesis,the political process as the three methods for an exchange process of legislation on the imbalance is on dialysis,explain its main contribution lies in the rational economics on the assumptions and introduce the concept of political transaction market,and legislative election the political behavior of the core and the game in the process of legislation is very close."Regulation of highway toll fees standards link to engineering and service quality in Sichuan”since April 1 2016,the formal implementation of the "Regulation",although the non typical legislative activities,but throughout the drafting,demonstration and implementation process,but also has the obvious characteristic of administrative legislation.The resulting transfer of resources and interests,permeated with the administrative power and the administrative relative party right inequalityThis paper focuses on the " Regulation " of the draft,demonstration and implementation process,from the perspective of public choice theory to analyze the existing risk prevention scheme of risk,explore the "legislative measures" to implement the balanced way of relief,reasonable boundary failure and interest group theory of government intervention from the government of administrative leadership the legislation and the incentive compatibility conditions of the destruction of balance of legislation to study the field of administrative law,legislation imbalance,specific analysis of the "measures" to implement risk to prove the disadvantages of administrative leading legislation.Pointed out that through the implementation of strict internal control mechanism design,good publicity and guidance and strong measures to protect the policy landing,while achieving administrative goals,taking into account the maximum social benefits.In the China characteristics of legislative background for the public choice theory to promote the effective entry point of balance of legislation,to improve the overall imbalance of China administrative legislation as the goal,continuously and comprehensively improve the legislation of public choice mechanism.
