Research On The Improvement Of Non-criminal Treatment Measures For Young Juveniles Involved In Crimes

In recent years,young people under the age of 14 have been continuously exposed to serious social harms.How to deal with these young children who touch the law has triggered social debates."Youngsters" refers to minors under the age of 14;"involved in crimes" refers to acts committed by minors who are not criminally punishable due to the age of criminal responsibility and who commit serious social harm as stipulated in the criminal law.In recent years,minors under the age of 14 have severely jeopardized the society.Japan,France,China's Taiwan region,and Macao have incorporated such young people involved in crimes of youth into the system of juvenile delinquency.Although this kind of juvenile criminal law in China stipulates the measures for instructing parents or guardians to discipline and accept and educate,this measure system is not perfect in practice,and these measures also have many problems in the specific operations.For example,there is a lack of transitional measures between parental or guardian discipline and foster education.Parents or guardians lack parental education and training.There is confusion in the execution site for adoption and education,the application conditions are not clear,there is a lack of an age limit,and the procedure is flawed.There are procedures for receiving work education.The irrational object,the rigid management and teaching model,and the stigma that make enrollment difficult.The problems existing in the above-mentioned non-criminal treatment measures for juvenile offenders in mainland China can be improved in several ways.One is to increase the correction of the nature of community education as one of the parent-guardian disciplines and foster education.The second is to attach importance to the role of correction and education in ordinary schools;the third is to clearly define the conditions for application of the system of adoption and education,the minimum age of application,the change of the place of implementation to a work-study school,and the inclusion of decision procedures in the judicial system;Education has been improved,and recommendations have been made on the procedures for admission,management,management,and teaching methods of the work-reading education.Fifth,in order to better achieve the effect of parental and guardian management,proposals have been made for the addition of parenting education.
