Research On The Legal Issues Of The Distribution Of Environmental Benefits In The Context Of Lancang-Mekong Cooperation

Since entering the industrial era,the economy has developed rapidly,with the worsening of the ecological environment,the shortage of natural resources and the increasing behavior of pollutant discharge by human beings.Faced with such a severe environmental situation,mankind began to realize the importance of maintaining the ecological environment and maintaining the balance of the ecosystem.Widespread and widespread environmental problems have created a new type of interest--environmental interests.Human beings are different from each other in the same environment,so how to allocate environmental benefits is an important problem for scholars.This study puts the problem of distribution of environmental benefits under the international background of "Lan Mekong cooperation mechanism",and begins with the definition of the concept of environmental benefits distribution,analyzes the essence of environmental interests,realizes the distribution of environmental interests justice,and provides the theoretical premise for the allocation and utilization of water resources and the protection of biodiversity in the countries of the LAN Mekong cooperation.This paper is divided into four parts besides the introduction.Among them:The first part is about the basic concept of the distribution of environmental benefits.On the basis of the analysis of "environment" and "interest",the "environmental interests" are explained.On this basis,the distribution of environmental interests is analyzed,the nature of environmental interests is discussed,the nature of environmental interests is recognized and the purpose of distribution is achieved.The second part introduces the environmental benefits of lancai Mekong cooperation.Lancang Mekong cooperation is mainly based on the Lancangjiang Mekong River.However,due to the different geographical location and economic development in the Lancang basin,different countries have different emphasis on the development of water resources.Different countries have different demands on environmental interests and the game of environmental benefits,mainly through China's emergency water supplement to the lower Mekong River countries.Two aspects of Lanmei cooperation and transboundary biological corridor construction are analyzed.The third part,from the perspective of international law,focuses on the analysis of some international treaties or agreements on the distribution of river water resources and the protection of biodiversity resources by the countries of the Mekong cooperative countries,and finds out the problems in the laws and regulations concerning the distribution of environmental interests.Deepen the development.The fourth part puts forward some suggestions for the allocation of environmental benefits of Lancang Mekong cooperation.The distribution mechanism of the benefits of the LAN Mekong cooperative environment is constructed mainly through the establishment of two ways to establish the allocation mechanism of water resources development and utilization and the benefit sharing mechanism of biodiversity conservation in the LAN Mekong cooperative region.At the same time,through the improvement of the dispute settlement mechanism of the Mekong cooperative countries,the equal dialogue and consultation of all countries will be realized so as to guarantee mutual benefit and common development among all countries.
