Thinking About The Legal Issues Of The Participants In The Early Stage Of My Country's PPP Projects

As our country accelerates the transformation of government functions,the demand for infrastructure construction and public product services is expanding in the "new normal" government institutions.At the same time,the government's increasing efficiency and quality requirements for "public products" and the relief of financial pressure are becoming more and more apparent.The PPP model,"the cooperation between government and social capital",as an important means in the global economic construction,has also been widely applied in the construction of public infrastructure and the construction of public service in China.In recent years,the PPP model has been carried out in full swing in the public field of China,and more and more attention has been paid to the operation and supervision of the PPP model.From the national ministries and commissions to the local people's governments at all levels,all kinds of standardized documents for the operation of the PPP model have been introduced.At the same time,in the PPP project participation,the government has set up PPP project implementation institutions and platforms in various levels and fields,and the social capital is also eager to participate in the construction and operation of the PPP model.The use of PPP model in China is still in the early stage of development,but a large number of PPP projects have been set up,involving billions of funds.Such a huge amount of projects and the amount of the project will inevitably put forward a complicated and severe test on the related regulation and regulation.In the face of the characteristics of the fragmentation and domain of the regulation of the PPP project running process in the existing normative documents,this paper analyzes and combs the more mature PPP model project process of our country,and generalizes the early stage of the PPP project process,and points out the basis and significance of the division.At the same time,this article focuses on the relevant legal problems of the participants in the early stage of the PPP project and the lack of the main body participation system in the early stage of the project,and puts forward some suggestions for the improvement of the main body of the PPP project in China.This paper focuses on the problems in the early stage of the PPP project found in the practice,and discusses the possibility of the possibility of the risk caused by the procedural issues related to the project demonstration and the establishment of the item company in this stage.It also tries to give the direction of regulation or solution in the process of the PPP project in the prophase of the rule of law from the relevant government departments,professional service institutions and three social capital parties.
