An Empirical Study On The Legal Issues Of Special Equipment Safety In My Country

With the acceleration of urbanization and rapid economic development in China,special equipment is gradually well known by people,and has been well developed and used.In different industries,the scientific and rational use of special equipment has created higher economic benefits for the development of all walks of life.The number of special equipment is increasing and widely distributed.However,some unreasonable and irregular use of special equipment is becoming increasingly prominent,resulting in frequent accidents of special equipment.Therefore,if we do not strengthen the safety supervision of special equipment,it may lead to serious accidents in production safety,endanger social production and people's lives,and even endanger the national economic security.In order to effectively prevent and contain the occurrence of safety accidents and ensure the safe operation of special equipment,it is necessary to strengthen the supervision of special equipment.The Special Equipment Safety Law of the People's Republic of China came into effect on January 1,2014.Its promulgation has provided a better legal basis for the special safety supervision.As a new law with short implementation time,there are still some problems in the implementation process.Based on the summary of grass-roots work experience in recent years,this paper firstly summarizes and analyzes the concept,safety status,supervision status and legal regulations of special equipment in China,and puts forward some existing problems of laws,regulations and safety supervision.The public participation ad hoc management mechanism has not been established and perfected,and the trade association has not fully played its role.At present,with the continuous updating of science and technology,the supervision and inspection of special equipment also need timely updating and reform,so as to keep up with the development of the times.On this basis,drawing on the research results of some foreign ad hoc legal systems,this paper puts forward the safety regulations,safety technical specifications and standards which conform to the ad hoc safety.And through the establishment of a variety of cooperative supervision methods,give full play to the advantages of social co-operation supervision,research new inspection and testing mode,reasonable set up inspection and testing institutions,strengthen the safety supervision of China's special equipment,ensure the safe operation of special equipment.
