Study On The Legal Regulation Of Special Equipment Safety In China

The study of the legal regulation of special equipment safety plays an important role,which can ensure the safe operation of special equipment,improve the safe working environment in the workplace,reduce safety accidents of special equipment,protect citizens' personal health and property safety and maintain good social order.Although special equipment safety situation has been improved since the enactment of "the Special Equipment Safety Law of the People's Republic of China"(hereinafter referred to as the "special equipment safety law ")in 2014,there are still many problems to be solved in practice.Through literature analysis,comparative method,empirical research method to analysis and summarize the problems existing in the legal regulation of special equipment safety in China.For example,The legal system of special equipment is not perfect yet,although the complete five levels of legal system-laws,regulations,rules,safety technical specification,and standard-has been established,there are still many problems to be solved like the unsmooth and contradiction between various levels;The advent of “Internet Plus” and the era of big data,makes it hard for the safety supervision and inspection and testing of special equipment in China to adapt to the development in new situation,which,therefore,needs urgent reform;The mechanism of special equipment safety management of Social public participation has not yet been established and perfect,the lack of social cohesion and the issue of multi-governance remain to be solved.Based on the related theory of law and through the research achievements in the field of special equipment safety supervision at home and abroad,this paper comes up with some advice about improvement of legal regulation system for special equipment safety in China from the perfection of administrative regulations and rules,safety regulations and standards of technology with the "special equipment safety law",the establishment of multi-supervision mode,the exertion of social cohesion to the reform of socialization of the inspection and testing institutions,the establishment of a national special equipment safety supervision information system platform--take "Internet plus" safety supervision so as to improve the security situation of special equipment in China.
