In 2013,China set off a wave of government-social capital cooperation(Pubic-Private-Partnership,or PPP)because the model partly alleviated the financial pressure of the government,improved the quality of public goods and improved the efficiency of product output.Therefore,the provision of public goods has changed from being provided by the government alone to the cooperation between the government and social capital,so as to jointly promote the construction of the cooperation project between the government and the social capital.At present,our country lacks the top level legal design of PPP at the national level,and there is no special project supervision organization from the legal level,which leads to the government and the society.The power of the regulatory body of the capital cooperation project is distributed in the dual structure of the government departments and the project supervision main body,and the participation of the government over-the-place and the absence of the supervision,the social capital and the public's participation in the supervision is low,The establishment of a series of PPP project supervision problems such as the single supervision mode of the PPP project and the low information disclosure level of the social capital project.Therefore,the design of PPP top-level laws and regulations should be carried out in China to define the subject of the project supervision,so as to prevent the supervision of the multiplecross-management in the decentralization and supervision of the supervision power,to pay attention to the introduction of the public participation,to pay attention to the combination of the payment mechanism and the performance supervision,so that the consumers are directly involved in the project Supervise and guarantee the citizens' participation in supervision and the smooth supervision channels from the legal level;We should focus on the definition of the responsibility boundary of government departments and the construction of government supervision ability;We should pay more attention to the combination of various supervision methods to make the public participate in PPP project supervision;We should pay attention to the information disclosure of PPP projects and break the information asymmetry of all parties involved in government and social capital cooperation.
