Government And Social Capital Cooperation(PPP) Model Research On Legal Supervision

With the continuous development and progress of China's economy,the continuous increase in the total population,the accelerating urbanization and the continuous updating of national demand,China's public infrastructure construction demand presents an“exponential growth”.However,the deficiencies of government departments in the construction fund,planning capacity and operation efficiency of public infrastructure have gradually emerged,and relying solely on government departments as the main body of investment,construction and operation has been difficult to meet the needs of the public.In this context,the model of cooperation between government and social capital has begun to be developed rapidly in China.As a result,the investment and financing channels have been vigorously developed,social capital has been gradually infused,a fair competition mechanism has been established,and a loose investment policy in infrastructure investment,construction and operation has been adopted.However the vacancy in cooperation supervision is becoming more and more obvious.In consideration of the inevitable trend of development of foreign and Chinese government and social capital cooperation,and the necessity of PPP legal supervision,this study aims to grasp the status quo of development and supervision of government and social capital cooperation,and to analyze the current regulatory approaches for government and social capital cooperation,to summarize the advantages and disadvantages of each PPP regulatory approach through a comparative analysis on the regulatory approaches,supervision process and supervision effects of various countries,at the same time,to study and judge the problems existing in the development and supervision of government and social capital cooperation mode,and seek effective ways to improve legal supervision,hoping to provide corresponding reference for the promotion and improvement of PPP mode.The first part is the combing of the study background,significance and method.The background and significance of selecting this subject was combed in details.On the basis of identifying the objectives of this study,relevant literature at home and abroad was collected,relevant research overviews were composed,and the basic study methods and study ideas were determined.The second part is the explanation of related concepts.It firstly explained the concepts related to government and social capital cooperation,including definition,historical evolution,feature analysis,and type introduction.Secondly,it explained concepts related to government and social capital cooperation model supervision,including the definition,necessity and significance.The third part is an analysis on typical cases of foreign PPP models.It sorted out the relevant legal documents and supervision methods of foreign government and social capital cooperation mode,and summarized its development mode and experience by analyzing the typical cases.The fourth part is the sorting out of the PPP supervision mode in China.Through field research,interviews and other specific study methods,it summarized the shortcomings of the regulatory subject,regulatory methods and their regulatory contents in the government and social capital cooperation mode,and analyzed the causes of such problems.The fifth part is the countermeasures and suggestions for optimizing the legal supervision for government and social capital cooperation.Based on the problems and causes,the paper proposed corresponding countermeasures and suggestions from the perspectives of different subjects and different links,hoping to provide some reference for optimizing government and social capital cooperation supervision.
