Research On Government Behavior Anomie In The Process Of Land Acquisition And Demolition

From Chinese reform and opening,along with the rapid development of Chinese economy and the acceleration of urbanization,various kings of conflicts of interest caused by large-scale land expropriation resulted in social problem.Based on this situation,the issue of land expropriation and house demolition has been paid more and more attention.The report of the 19 th CPC National Congress mentioned "building a service-oriented government which is satisfied with the people," which requires the government to act in a more orderly and rational manner in the process of house demolition and land expropriation,focusing on service and supervision rather than traditional way of undertaking all things."both judges and athletes",at the same time to the direction of harmonious demolition,to further improve the satisfaction of the people and the credibility of the government.In this paper,we analyze objectively the problems existing in the process of demolition in our country,combining with case of the abnormal behavior of the government in the process of land expropriation and demolition,such as the non-standard procedure,unreasonable compensation standard,violent demolition,inadequate resettlement and so on,and analysis and summary in terms of government offside,out of position,absence.At the same time,on the basis of the public governance theory,Marxist land rent theory and game theory,according to the role of the government in land expropriation and demolition,I adopt the methods of literature research,theoretical integration with practice,comparative analysis and so on.According to the latest policy of land expropriation and demolition,this paper analyzes and discusses the reasons why the government behavior is out of order.Taking Yihuang demolition self-immolation in Jiangxi Province and harmonious demolition of Zheng Dong New District as two typical cases,through the analysis of both positive and negative sides,this paper discusses how to change the government's behavior in terms of transforming government function,providing public service,strengthening supervision and management.Finally,countermeasures and suggestions are put forward from the aspects of perfecting the legal system of collection and dismantling,transforming the function of government into service-oriented government,and strengthening the supervision and punishment mechanism.The main conclusions of the study are as follows: the conflict of interest between the subjects of land expropriation and demolition is the fundamental cause of land expropriation and removal problem.The lack of legal system of land expropriation and demolition in China is the root cause of government behavior disorder in land expropriation and demolition.Therefore,only by formulating the system of land expropriation and demolition,perfecting the legal system of expropriation and demolition,and standardizing the behavior of the government through legal means,can the problem of derangement of government behavior be solved from the root cause.The government should clearly define its role and responsibilities,improve the policy and system of "harmonious demolition" through constant guidance,and give further play to the role of government guidance and mediation,market-leading,mass participation and supervision,realize the transformation of the management-oriented government to the service-oriented government.Then the interests of different subjects can be balanced in the process of demolition,and the work of land expropriation and demolition can be carried out smoothly,harmoniously and orderly.
