At present,our country is in the crucial period of deepening reform in an all-round way.Social transformation and economic transition have made profound changes in social structure.Contradictions and disputes have emerged in endlessly,and public opinion politics has quietly risen.The old social management system can no longer meet the needs of economic and social development and the resolution of social contradictions.It is urgent to promote the reform of rule of law in the field of social governance.In order to meet the needs of the times,the Party Central Committee put forward the strategic idea of "ruling the country by law in an all-round way" at the Fourth Plenary Session of the Eighteenth Central Committee of the Party,and for the first time put forward the concept of "improving the legalization level of social governance".The Nineteenth National Congress put forward the idea of innovating the social governance system and constructing a new social pattern,and emphasized "improving the legalization level of social governance".The legalization of social governance is a key link to comprehensively promote the rule of law,and also an important measure to build a society ruled by law.It can be seen that the rule of law in social governance is an important issue in the field of social governance in the new era.It is an important mission entrusted to us by the times to discuss the problems and the ways to realize the rule of law in the process of social governance in China.In order to better study the subject of the rule of law in social governance,this paper first discusses the relevant theory of the rule of law in social governance.By straightening out the historical development of social governance,we can define the concepts of social management,governance and social governance;by comparing the legal system with the rule of law,the rule of man with the rule of law,we can clarify their respective meanings;by defining the concepts of the rule of law and the rule of law of social governance,we can make clear the research object of this paper.Then it points out that Marx,Engels,Mao Zedong's theory of social management and rule of law and the theory of socialist social management and rule of law with Chinese characteristics are the theoretical cornerstone guiding the rule of law in China's socialgovernance.Xi Jinping's thought of rule of law in the new era is the action guide guiding the rule of law in China's social governance.These theories are the theoretical research and practice of the rule of law in China's social governance.The development has made clear the theoretical support.It emphasizes three basic principles that must be adhered to in promoting the legalization of social governance:first,adhere to the leadership of the Party,strengthen the leadership of the Party in the legalization of social governance;second,adhere to the people's dominant position,stimulate the vitality of public participation in social governance;third,adhere to equality before the law,help the legalization of social governance,highlighting the unique China of the legalization of social governance in China.The nature of legislation is not high and does not meet the needs of the legalization of social governance,under the guidance of Xi Jinping's thought of social governance in the new era,we should put forward scientific legislation and democratic legislation,speed up the legislation in the field of social governance,improve the legal system of social governance,and provide legal protection for the legalization of social governance.Thirdly,we should implement the "three systems" of administrative law enforcement,strictly enforce the law,build a government ruledby law,and play a leading and leading role in social governance.Fourthly,we should adhere to the Party's leadership and judicial independence,deepen judicial reform,promote judicial administration,judicial openness and judicial democracy,and strengthen judicial supervision.This paper combines the theory of social governance and legal governance with the practice of legalization of social governance in socialism with Chinese characteristics through the methods of literature research,integration of history and logic,and comparative research.It also discusses the problems and challenges faced in the process of legalization of socialism with Chinese characteristics and puts forward countermeasures.This will contribute to the formation of a new pattern of social governance in China and the establishment of a new system of
