With the increase of our citizens ' awareness of gender equality,citizens ' demand for gender equality in the field of employment is becoming more and more strong,but China's existing legal system can not respond to these claims.In theory,our country needs to make clear the connotation and constitutive elements of gender discrimination in employment,especially to discuss the necessity of subjective elements in the constituent elements in depth.On the basis of combing out the present situation of gender discrimination in employment in China,this paper analyzes its causes.The causes mainly include the bondage of traditional ideas,the neglect of the difference of individual working ability,the lack of government guidance and the insufficiency of legal guarantee,among which the insufficiency of government guidance is the main reason,and the weakness of legal guarantee is the direct reason.Both Taiwan and mainland regions are the successors of Chinese traditional culture,and both belong to the civil law system,and the legal regime of anti-employment gender discrimination in Taiwan can be used for reference in mainland China.Through the analysis of the legal system of anti-employment gender discrimination in Taiwan,we can find that the Taiwan region has formed a relatively perfect anti-employment gender discrimination legal system,in which not only the specialized agencies have been set up to protect the gender equality of employment,but also the administrative functions have been strengthened and the government's responsibilities have been clarified.Based on Taiwan's legislative experience and the reality of our country,this paper proposes to construct a legal system of anti-employment gender discrimination in mainland China,including the enactment of the "Anti-employment Gender Discrimination Law" and the revision of the corresponding laws and regulations.
