The formation of the socialist legal system with Chinese characteristics has put forward new and higher requirements for the implementation of the law.With the continuous strengthening of people’s democratic concepts in recent years,the awareness of participating in local legislation has also been continuously strengthened.At the same time,it also exposed many problems in local legislation.In the face of the new challenges put forward by local legislation in the current era,we must first clarify the train of thought,carefully analyze the quality problems existing in local legislation,and conduct in-depth research on them,in order to solve the problem,to improve the local legislative system and improve our country.The quality of legislation.After the revision of the "Legislation Law" in 2015,with the further expansion of local legislative bodies,new challenges have been raised to the quality of local legislation.Starting from theory and practice,this paper conducts in-depth research on the existing problems of local legislation quality,and puts forward suggestions and countermeasures for specific problems.The full text is divided into the following four parts:The first part,firstly expounds the basic connotation of the quality of local legislation and local legislation,and secondly,according to the actual situation of judging the quality judgment standard of local legislation in China,combined with practice to clarify the local legislative quality evaluation standard applied in this paper.The second part is mainly to explain the performance of existing problems in the quality of local legislation.In practice,the problems of the quality of local legislation in China are mainly reflected in the problems of local protectionism and departmental protectionism,local legislative procedures,legislative supervision and legislative techniques.The third part analyzes the reasons for the problems of the quality of local legislation in China.The problems of local protectionism and departmental protectionism are mainly due to the old legislative concept,the driving of departmental interests and the imperfect local legislative mechanism.The problems of the program are due to the non-specialization of the drafters,the imperfect review system,and the imperfect public participation system.The problems existing in the legislative supervision system are mainly due to the single mode of legislative supervision and the unclear provisions of the legislative supervision body.The problem of legislative technology in local legislation is that the local legislative team is not self-constructed,and the legislative technical norms lack institutionalization.The fourth part is about the countermeasures and suggestions for improving the quality of local legislation in China.First of all,we must deal with the two important relationships in local legislation,the relationship between the number of legislation and the quality of legislation,the relationship between the state’s rule of law authority and the characteristics of local legislation.On this basis,it is also necessary to establish and improve local legislative procedures,strengthen the building of legislative teams,improve local legislative supervision,and improve local legislative techniques.Only by perfecting all the above links can the quality of local legislation be guaranteed.
